HomeMy WebLinkAboutBy-law 3994/71THE CORPORATION OF THE TOWNSHIP OF PICKERING BY-LAM NUMBER 3 1 q 1/71 Being a By-law to Licence, Regulate and Govern the owners and drivers of Cartage Vehicles and to repeal By-law Number 3543. WHEREAS the Corporation of the Township of Pickering has pursuant to The Municipal Act, R.S.O. 1960, Chapter 249, Section 395, authority to enact this By-law. NOW THEREFORE THE COUNCIL OF THE TOWNSHIP OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. For the purpose of this By-law: (1) "Cartage Vehicle" means and includes a motor or other vehicle used for carriage of goods within the Township but does not include: a) any vehicle used for hire for the carriage of persons; b) a vehicle hired by the owner thereof to a person who takes exclusive possession thereof and drives the same by himself or his employee and who does not hire such vehicle to any other person. (2) "person", includes any individual, association, firm, partnership or corporation and the heirs, executors, administrators or other legal representatives of ouch person. 2. a) No person, being the owner of a cartage vehicle or being the lessee of such a vehicle rented by the owner thereof shall use or allow the use of such a vehicle within the boundaries of the Township of Pickering without first obtaining a licence for such vehicle pursuant to the provisions of this by-law. b) No person, being the driver of a cartage vehicle shall use such a vehicle within the boundaries of the Township of Pickering unless such vehicle is licenced pursuant to the provisions of this By-law. 3. Owners of cartage vehicles shall take out separate licences for each such vehicle and in the application therefor each vehicle in respect of which a licence is sought shall be identified in such manner as is required by the Township of Pickering. 4. Every person licensed as a cartage vehicle owner shall receive with each licence a metal plate issued by the Township of Pickering bearing an identifying number and shall at all times keep such plate securely and prominently affixed to the front portion and on the outside of the vehicle in respect of which the same was issued. Continued ...... 2 -2- 5. The owner of a cartage vehicle shall at all times while the vehicle is being used as such keep in the vehicle the licence issued therefor by the Township of Pickering. 6. No-person licenced under this By-law shall carry in any vehicle used for hire a load in excess of that for which the commercial motor vehicle permit was issued, as stated upon such permit. 7. The owner of a cartage vehicle in respect of which a licence has been issued under this By-law shall, when required, submit his vehicle for examination by the Township of Pickering or any person designated thereby, and no owner or driver shall, at any time, prevent or hinder the said Township of Pickering or person designated thereby, from examining the same. 8. Owner and drivers licenced under this By-law shall keep every vehicle clean and in good repair, and whenever the owner of any such vehicle receives notice, either given to him and signed by the Township of Pickering or any person authorized thereby, that such vehicle is not in a fit or proper condition for use, stating briefly the items complained of, such owner shall, within the time mentioned in such notice, put the same in a fit and proper condition. 9. Every such owner or driver licenced under this By-law shall, upon changing his address, notify the Issuer of Licences of such change within two days and give his new address. 10. The fee fur such licences shall be according to the following schedule; Truck or trailer up to but not including 1 ton load capacity - $5.00 Truck or trailer 1 ton up to but not including 5 ton load capacity - $10.00 Truck or trailer 5 tons up to but not including 10 ton load capacity - $15.00 Truck or trailer 10 tons or over load capacity - $20.00 plus $ 5.00 for each additional 5 tons or part thereof load capacity over 10 tons. 11. Licences shall be issued on behalf of the Township of Pickering by its By-law Enforcement Officer and every such licence shall expire on the 31st day of December in the year of its issue. 12. Any person convicted of a breach of any of the provisions of this By-law shall forfeit and pay, at the discretion of the convicting Magistrate, a penalty not exceeding Three Hundred Dollars ($300.00) exclusive of costs, for each offence. 13. By-law Number 3543 be and the same is hereby repealed. 14.
