The Council of the Corporation of the Township of Pickering in accordance withe the provisions of The Planning Act, R.S.O. 1960 as amended, hereby enacts as follows: 1. The attached map and explanatory text, constituting Amendment No. 16 to the Official Plan of the Township of Pickering Planning Area, is hereby adopted. 2. That the Clerk is hereby authorized and directed to make application to the Minister of Municipal Affairs for approval of the aforementioned Amendment No. 16 to the Official Plan of the Township of Pickering Planning Area. 3. Minister of Municipal Affairs - 1 - a) TITLE Amendment No. 16 to the Official Plan of the Township of Pickering Planning Area. b) The following Text and Map, designated Schedule 1, constitute Amendment No. 16 to the Official Plan of the Township of Pickering Planning Area, and is herewith submitted for the approval of the Minister of Municipal Affairs. - 2 - ITEM 1 - LAND USE LOCATION Part Lot 21, Concession 3, (South side of 4th Concession Road, West of Brock Road), being the lands as shown on the attached Schedule 1 as Item 1, which lands are more particularly described in the Appendices attached hereto. CHANGE: "RURAL" to "INDUSTRIAL" STATEMENT: To permit expansion of existing industry. The applicant owns 39.671 acres containing a sash manufacturing industry which is an existing non- conforming use. This use has been permitted minor extensions in recent years through the authority of the Committee of Adjustment. Due to the applicant's desire to do long range corporate planning, expansion through the Committee of Adjustment is no longer acceptable. Therefore this application is to re-designate the portion of their holdings containing the industrial buildings, parking area, accessory caretaker's residence, driveway access, and immediately surrounding lands sufficient to accommodate setbacks and moderate expansions to the existing industry. For these reasons, the portion to be re-zoned is irregular in shape and ineludes 13.720 acres. The northern 100' - 3 - wide strip of land abutting the 4th Concession Road contains the driveway and caretaker's residence. The industrial buildings (including accessory apartment units) are on the larger rectangular rear portion abutting the C.P.R. line. The total holding of the applicant is bounded on the south by the C.N.R. line, on the west by "pit and quarry" zoned lands (relatively inactive gravel pits), on the north by "pit and quarry" zoned lands (used for gravel and residences north of the 4th Concession Road), and a small pig farm (with some industrial type activities) and a tributary of the Duffins Creek to the east. The area west of the Creek, north of the C.N.R. line, south of the 4th Concession Road, and east of Sideline 22 is proposed for industrial purposes in the Brock hamlet study which will form the basis for preparation of a District Plan. APPENDIX 1 to AMENDMENT NO. 16 to the OFFICIAL PLAN of the TOWNSHIP OF PICKERING PLANNING AREA The following legal description is included for the purposes of identification only, with this Appendix not actually forming a part of this Amendment No. 16 to the Official Plan. ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the Township of Pickering and County of Ontario, and being composed of part of Lot twenty-one in the Third Concession for the said Township, which said parcel may be more particularly described as follows: PREMISING that the bearing of the northerly limit of the said Lot 21 is north 701 57' oo" east and relating all bearings used herein thereto; COMMENCING at a point in the said Lot 21 which may be located as follows: BEGINNING at a point in the northerly limit of the said Lot 21 distant easterly therein 693.56 feet from the north-westerly angle thereof; THENCE south 18° 39' 00" east to a point of intersection with a line drawn parallel to the said northerly limit and distant southerly therefrom 17.0 feet measured at right angles thereto, a distance of 17.0 feet; THENCE north 70" 57' 00" east along the said parallel line, a distance of 288.30 feet to the point of commencement; THENCE from the point of commencement south 18° 45' 20" east, a distance of 600.00 feet; THENCE south 700 57' 00" west, a distance of 460.0 feet; - 2 - THENCE South 18° 45' '40" east to a point of inter- section with the nort_erly limit of the Canadian Pacific Railway lands, a distance of 1,128.93 feet; THENCE north-easterly along the said northerly limit of the Canadian Pacific Railway lands, being a circular curve to the right of radius 4,626.75 feet, an are distance of 638.64 feet ha having a chord equivalent of 638.13 feet measured on a chord bearing of north 38° 03' 15" east; THENCE north 47` 59' 30" west, a distance of 17.0 feet; THENCE on a curve to the right of radius 4,643.75 feet, an are distance of 101.30 feet, having a chord equivalent of 101.30 feet measured on a bearing of north 42° 38' 00" east; THENCE south 46^ 44' 30" east, a distance of 17.0 feet; THENCE on a curve to the right of radius 4,626.75 feet, an arc distance of 77.76 feet having a chord equivalent of 77.76 feet measured on a chord bearing of north 43° 44' 22" east; THENCE north 620 38' 40" west, a distance of 189.92 feet; THENCE north 180 45' 20" west to a point of inter- section with the first mentioned parallel line, a distance of 1,161.36 feet; THENCE south 700 57' 00" west along the said parallel line, a distance of 100.00 feet more or less to the point of commencement.
