BEING A BY-LAW TO AMEND RESTRICTED AREA BY-LAW 2511,
as amended;
WHEREAS the Council of The Corporation of the Township of
Pickering deems it desirable to provide for a free standing;
restaurant to service the industrial area in Lot 19, Range
3 of the Township of Pickering;
AND WHEREAS an amendment to By-law 2511 is necessary to
provide for this amenity which is in accord with the spirit
and intent of the Official Plan;
NOW THEREFORE BE IT AND IT IS HEREBY ENACTED:
A. TEXT AMENDMENT
By-law 2511 as amended, is hereby further amended by
adding thereto the following as Section 18.3 thereof:
18,3 EXEMPTION
18.3.1 Part Lot 19 Range 3
Notwithstanding the provisions of Sections
18.1 and 18.2 hereof a combined restaurant
and tavern, having; a minimum southerly
side yard setback of eleven (11) feet may
be constructed and operated on that part
of Lot 19 Range 3 of the Township of Pickering
designated as 11M2S (SPECIFIC)" on the plan
annexed hereto as Schedule "A" in addition
to the uses set out in said Section 18.1:
B. SCHEDULE "A" AMENDMENT
Schedule "A" of By-law 2511.x8 amended, be and the same
is hereby further amended by altering the zone designation
from 11M.2S'' to 1'M2S (SPECIFIC)", for the lands designated
as 942S (SPECIFIC) " in Lot 19, Range 3 and shown on
Schedule ".A" annexed hereto.
C. That By-law 2511 be and the same is hereby amended only to
the extent necessary to r!i.ve effect to the provisions
of this By-law.
D. No part of this by-law shall come into force without
the approval of the Ontario Municipal Board. But subject
to such approval this by-law shall take effect from the
day of passing thereof.
