HomeMy WebLinkAboutBy-law 4186/72THE CORPORATION OF THE TOWNSHIP OF PICKERING BY-LAW NUMBER ??b lc? 7' being a by-law to authorize the construction of watermains as local improvements under the provisions of section 11 and 68 of The Local Improvement Act, R.S.O. 1970. WHEREAS it is expedient that the petition fox wateimains on Kingston Road, Finch Avenue, Guild Road and Royal Road be granted and that the construction thereof shall be undertaken at the cost hereinafter set out as local improvements under the provisions of section 11 of The Local Improvement Act, R.S.O. 1970; AND WHEREAS the cost of the said works is to be levied by imposing special assessments therefor against the lands abutting on the said streets in a local improvement area hereinafter defined pursuant to section 68 of The Local Improvement Act; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF PICKERING ENACTS AS FOLLOWS: 1. That watermains be constructed on Kingston Road from Valley Farm Road to a point 600 feet east of Brock Road; on Finch Avenue from Royal Road to a point 185 feet west of Guild Road; on Guild Road from Kingston Road to Finch Avenue; and on Royal Road from Kingston Road to Finch Avenue, at an estimated cost of $130,000.00 as local improvements under the provisions of The Local Improvement Act. 2. The entire cost of the said works is to be specially assessed upon land abutting directly on the works and immediately benefitting therefrom. The entire cost, including debenture: charges, shall be assessed and levied on the rateable property fronting or abutting on both sides of Kingston Road from Valley Farm Road to a point 600 feet east of Brock Road; on Finch Avenue from Royal Road to a point 185 feet west of Guild Road; on Guild Road from Kingston Road to Finch Avenue; and on Royal Road from Kingston Road to Finch Avenue which are hereby defined a local improvement area pursuant to section 68 (1) of The Local Improvement Act, R.S.O. 1970, as amended, and be paid by an annual rate of $1.66 per foot on the land specially assessed. - 2 - 3. The Engineer of the Corporation is hereby authorized to make such plans, profiles and specifications and furnish such plans and information as may be necessary for the making of contracts for the doing of the works or for carrying out the same by day labour and the works shall be carried on and executed under the superintendence and according to the directions and orders of the said Engineer. 4. The entire cost of the said works is to be paid by the issuing of debentures bearing interest at the rate of nine per cent per annum and be repaid by the special assessments over a term of 20 years. 5. The Treasurer of the Township may, subject to the approval of Council, agree with any bank or person for temporary advances of money to meet the cost of the works pending completion thereof. 6. Any person whose lot is specially assessed may commute by a payment in cash the special rate imposed by paying the cost of construction assessed upon such lot without the interest forthwith after the special assessment roll has been certified by the Clerk but may not commute after the debenture by-law has been passed. 7. This By-law shall not come into effect until the approval of the Ontario Municipal Board to the undertaking herein is obtained.
