WHEREAS THE COUNCIL of The Corporation of the Township of Pickering deems it desirable to amend the provisions of By-laws 1978, 2511, 2520, 3036 and 3037 as amended, pursuant to the provisions of The Planning Act R.S.O. 19709 Section 35 as amended. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF PICKERING ENACTS AS FOLLOWS: A. TEXT AMENDMENTS That By-law 1978 be and the same is hereby amended as follows: 1. That Section 5 - Definitions be and the same is hereby amended by adding thereto the following new subsections: 5.2.1 AISLE, PARKING LOT Aisle shall mean that portion of the parking lot abutted on one or more sides by parking spaces, used to gain access to the parking spaces, and is not used for the temporary parking of vehicles. The minimum perpendicular width of an aisle used to gain access to a parking stall shall be 22 feet for two-way traffic and 12.5 feet for on_-way affix. 5.2.2 ARENA Arena shall mean an indoor artificial ice rink and ancillary facilities 5.2.3 ASSEMBLY AREA Assembly Area shall mean an area within a building or structure designed for assembly, including spectator and meeting space, but not including lobby areas and :th:r areas not used for spectator or meeting purposes. The assembly area includes aisle space in the spectator or meeting rooms. It does not include external aisle space which could not be used for spectator or meeting purposes, but which may include snack bars. 5.5.1 CAPACITY (BUILDING) Capacity shall mean permitted capacity by the authority having jurisdiction therein. continued .... 2 BY-LAW ti • s 8 REPEALED BY REPEALS AMENDED BY v a 5 g AMENDS 19 7 1 c2 S 1.), c? Y,:;12 D, -3636)3o37 DISPOSITION - 2 - 5.5.2 COMMERCIAL VEHICLE Commercial vehicle shall mean any motor vehicle having permanently attached thereto a truck or delivery body and includes ambulances, hearses, casket wagons, motor buses, mobile home and tractors, except that for the purposes of Section 6.1.13 neither a passenger car, station wagon, nor a one-half (112) truck shall be deemed to be a cc:s:+r ial vehicle. 5.7.1 DRIVEWAY Driveway shall mean the route by which vehicular access is gained to the parking lot from an opened maintained public road allowance. 5.16.1 GROSS FLOOR AREA Gross Floor Area for the purposes of parking calculations shall mean the total floor area of all floors including basements 5.16.2 GROSS LEASABLE AREA Gross Leasable Area shall mean the total gross floor area designed for tenant occupancy and exclusive use, including basements, messanines and upper floors if any; expressed in square feet and measured from the centre line of point partitions and from outside wall faces. 5.21.1 LOADING SPACE, BUS Bus Loading Space shall mean a minimum area of 400 square feet, having a minimum perpendicular width of 12 feet. 5.26.1 PARKING LOT Parking Lot shall mean a lot or portion thereof provided for the parking of motor vehicles accessory or incidental to the main use. - 3 - 5.26.2 PARKING SPACE Parking Space shall mean a usable and accessible area of not less than 200 square feet having a minimum perpendicular width of 9 feet, excluding aisle space and driveways to the parking lot, for the temporary parking of a vehicle. 5.26.3 PARKING SPACE, BUS Bus Parking Space shall mean an accessible area of not less than 400 square feet, having a minimum perpendicular width of 10 feet, excluding aisle space and driveways to the parking lot, for the temporary parking of a vehicle. 5.26.4 PARKING SPACE, WATERFRONT A Waterfront Parking Space (vehicular) shall mean an accessible area of not less than 300 square feet, exclusive of driveways or aisles, for the temporary parking or storage of vehicles with trailers. 5.31,2 VEHICLE Vehicle includes a motor vehicle, trailer, traction engine, farm tractor, road-building machine and any vehicle drawn, propelled, or driven by any kind of power. 5.32.4 YARD REQUIRED Required Yard for parking purposes shall mean the minimum main building yard setback from the property line required by the zone in which the property is located and not necessarily the distance between the property line and any building or structure thereon. 2 That subsection 5.21 be and the same is hereby deleted and the following inserted therefore 5.21 LOADING SPACE Loading Space shall mean an off-street space of a minimum rectangular size of Twenty (20) feet by Ten (10) feet with a vertical clearance of Fourteen (14) feet on the same lot with a building or contiguous to a group of buildings, for the temporary parking of a commercial vehicle while loading or unloading merchandise or materials and which abuts upon a street, lane or other appropriate means of access. continued .... 4 - 4 - 3. That subsection 5.26 be and the same is hereby deleted and the following inserted therefor 5.26 PARKING AREA A Parking Area shall mean one or more parking spaces, including related aisles, for the parking or storage of vehicles. 4. That a new Section 5 A General Provisions for all zones be added as follows: Section 5A General Provisions applicable to all zones. 5A. 1 VEHICLE PARKING 5A. 1 1 MINP4U1(jrY S70FT PARKING Parking shall be provided on the same lot in accordance with the following schedule: ZONE USE MINIMUM NUMBER OF SPACES ------------------------------------------------------ Residential single family - 1 space per unit dwelling - 1 space per 300 sq.. permitted ft. gposs floor area businesses devoted to permitted businesses for customers. multiple family horizontal - units without - 2 spaces per unit for attached garages occupants and visitors or - units with - 1 garage space per unit attached garages plus driveway space (in front?of the garage) equal to a parking space plus 1 visitor parking space located in the parking lot for each 4 units or portion thereof. Industrial Restricted Industrial - 1 space/600 sq.ft. gross floor area employees and customers Heavy Industrial - 1 space/600 sq.ft. gross floor area employees and customers All zones Schools elemcntary - I space for each staff (,junior and member senior) and - 1 bus space/0 class nursery. rooms secondary and - 1 space for each staff vocational member --l bus space/20 class- rooms and 1 space/10 students post secondary - 1 space for each staff member - 1 space/6 students churches - 1 space/4 persons capacity continued u. - y - ZONE USE MINIMUM NUMBER OF SPACES ----------------------------------------------------------------- All zones public buildings libraries, clinics - 1 space/250 sq.ft. gross floor area. - 1 space/60 sq.ft. floor area used for assembly arenas plus 1 space/200 sq.ft. floor area used for sports, entertainment, restaurant (excluding snack bar) and other ancillary uses. plus 1 bus parking space per dressing room plus loading and unloading areas separate from the parking area, bu-4 may include part of a driveway not leading to a parking area. plus controlled access from public roads to the parking area ?A.1.2 SUPPLEMENTARY PARKING REGULATIONS These principles apply to parking in all zones except in the case of single family or semi-detached residential uses. a) Except for commercial zones used for commercial purposes, frontyard parking, shall be limited to 20% of the total required parking area. Any frontyard parking area shall be maintained in good appearance and be paved. b) Sideyard parking spaces shall not be permitted within any required sideyard setback up to a maximum of 25 feet on one side and - feet on the other side. continued 7 5A 1.2. continued Yo gasoline pump or other service equipment intended for public use shall be located or maintained on a parking lot or parking area. k) all entrances and exits to parking areas shall be paved for a. minimum distance of 50 feet from ti7e font lot line and 10 feet from the side lot line where it abuts a street. 5. That sub-section 6.1.13a be and the same is hereby deleted and re-number sections b) c) and d) to a) b) & c) respectively. 6. That sub-section 7.1.1.1 be and the same is hereby amended by deleting, the words "Subject to 7.1.4" and deleting the sentence "Where adjacent build::+_ngs, or building within one hundred (100) feet on either side, have cnis sixty (60) foot front yard, then Section 7.1.4 shall not apply." 7. That sub-sections 7.1.3 '?1- -m3 the s^me is hereby deleted. 8. That sub-sections 7.1.4; 7.1.4.1; 7.1.4.2; 7.1.4.3; and 7.1.4.4 be an d the sa me are hereby deleted. 9. That sub-section 8.1.1.4 be and the same is hereby deleted. 10. That sub-section 8.1.5 be and the same is hereby deleted. 11. That Section 9 be and the same is hereby amended by replacing the title "S ection 9 - General Provisions" with "Section 9 - Adminis tration" with a corresponding amendment to the Table of Contents. 12. That sub-sections 9.3 and 9.3.1 be and the same are hereby deleted and the f ollowing inserted in Section 5A: 5A.2 PUBLIC UTILITIES AND SERVICES The Township of Pickering or any "local Board" thereof as defined in "The Department of Municipal Affairs Act", The Municipality of Metropolitan Toronto any telephone or telegraph company, transportation system owned or operated by or for the Township, any railway, or any Department of Federal or Provincial Government including the Hydro Electric Power Commission of the Province of Ontario may for municipal purposes or for the purpose of public services use any land or any building or structure in any zone notwithstanding that such building or structure or proposed use does not conform with the provisions of this By-law for such zone. However, such use, building or structure shall be as far as practicable in substantial compliance with the regulations for such zone as approved by Council on the recommendation of the Planning Board. Nothing in this By-law shall prevent the use of any land or a right-of-way for any oil, gas or other liquid pipe line and appurtenance thereto. continued .... - 7 - 5A.1.2, continued c) Rearyard parking shall be permitted in any zone. d) Where a parking area abuts a road allowance there shall be a 10 foot setback therefrom. e) Roofed parking structures, except completely underground garages, shall conform to the yard setbacks for the zone in which they are located. Underground parking shall not be permitted closer to any lot line than the depth below finished grade but need not exceed the setback of the main building. Wholly enclosed parking garages shall have a vehicular entrance way with a minimum unobstructed width of 15 feet. f) Surface parking areas, adjacent to residential and/or institutional zones, shall be screened from these zones. The screening shall in no way obstruct visibility on public roads, but it shall be at least 3 feet in height and be located between adjacent zone boundaries and the parking area. Such screening may include any or a combination of the following:- 1) a Bence or wall 11) shrubs or trees 111) depressed parking (at a lower elovation) g) All parking areas shall be maintained with a surface that is treated to prevent the raising of dust or loose particles, which surface is usable for twelve months of the year. h) The lights used for illumination of the parking lot or parking area shall be so arranged as to divert the light away from adjacent properties. i) A shelter, not more than 15 feet in height and not more than 50 square feet in area, may be erected in the parking area for the use of attendants. continued 8. 7(a) 13. That sub-section 9.5.4.be and the same is hereby re-numbered as section 5A.4 with the addition of the subtitle "FRONTAGE ON A STREET". - 8 - B. TEXT AMEUDMEDITS That By-law 2511 be and :;ae came is hereby amended as follows:- 1. That Section 2 - Defin-Lions be and the same is ziereby amended by adding thereto the following new subsections: 2.2 .I. J) No gasoline pump or other service equipment intended for public use shall be located or maintained on a parking lot or parking area. k) All entrances and exits to parking areas shall be paved for a minimum distance of 50 feet from the front lot line and 10 feet from the side lot line where it abuts a street. 6. That subsection 5.23 be and the same is hereby deleted. 7. That subsection 6.7(a) be and the same is hereby deleted. C. TEXT PX19 LMMTS That Sy-law 2520 be and the same is hereby amended as follows t 1. Any frontyard parking area shall be maintained in good appearance and be paved. b) Sideyard parking spaces shall not be permitted within any required sideyard setback up to a maximum of 25 feat on one side and 5 faet on the other side. c) Rearyard parking shall be permitted in any zone. Continued 18 -18- d) Where a parking area abuts a road allowance there shall be a 10 foot setback therefrom. e) Roofed parking structures, except completely underground garages, shall conform to the yard setbacks for the zone in which they are located. Underground parking shall not be permitted closer to any lot line then the depth below finished grade but need not exceed the setback of the main building. Wholly enclosed parking garages shall have a vehicular entrance way with a minimum unobstructed width of 15 feet. f) Surface parking area, adjacent to resi- dential and/or institutional zones, shall be screened from these zones. The screening shall in no way obstruct visibility on public roads, but it shall be at least 3 feet in height and be located between adjacent zone boundaries and the parking area. Such screening may include any or a combination of the following: 1) a fence or wall II) shrubs or trees III) depressed parking (at a lower elevation) g) All parking areas shall be maintained with a surface that it treated to prevent the raising of dust or loose particles, which surface is usable for 12 months of the year. h) The lights used for illumination of the parking lot or parking area shall be so arranged as to divert the light away from adjacent properties. i) A shelter, not more than. 15 feet in height and not more than 50 square feet in area, may be erected in the parking area for the use of attendants. j) No gasoline pump or other service equipment intended for public use shall be located or maintained on a parking lot or parking area. k) All entrances and exists to parking areas shall be paved for a minimum distance of 50 feet from the front lot line and 10 feet from the side lot line where it abuts a street. 6. That subsection 6.6 (a) be and the same is hereby deleted. 7. That subsection 6.7 (a) be and the same is hereby deleted. Continued 19. -19- D. TEXT AMENDMENTS That By-law 3036 be and the same is hereby amended as follows: 1. That Section 2 - Definitions be and the same is hereby amended by adding thereto the following new subsections: 2.2.1 AISLE, PARKING LOT Aisle shall mean the portion of the parking lot abutted on one or more sides by parking spaces, used to gain access to the parking spaces, and is not used for the temporary parking of vehicles. The minimum perpendicular width of an aisle used to gain access to a parking stall shall be 22 feet for two-way traffic and 12.5 feet for one-way traffic. 2.2.3 ASSE""BLY AREA Assembly area shall mean an area within a building or structure designed for assembly, including spectator and meeting space, but not including lobby areas and other areas not used for spectator or meeting purposes. The assembly area includes aisle space in the spectator or meeting rooms. It does not include external aisle space which could not be used for spectator or meeting purposes, but which may include snack bars. 2.10.1 CAPACITY (BUILDING) Capacity shall mean permitted capacity by the authority having jurisdiction therein. 2.13.1 COMMERCIAL VEHICLE Commercictl iehicle shall mean any motor vehicle having permanently attached thex'eto a truck or delivery body and includes ambulances, hearses, casket wagons, mobile homes, motor buses and tractors, except that for the purposes of Section 6.5, neither a passenger car, station wagon, nor a one-half (A-) ton truck shall be deemed to be a commercial vehicle. 2.17.1 DRIVEWAY Driveway shall mean the route by which vehicL.I-r access is gained to the parking lot from an opened maintained public road allowance. Continued 20. -20- 2.38.1 GROSS FLOOR AREA Gross Floor Area for the purposes of parking calculations shall mean the total floor area of all floors including basements. 2.38.2 GROSS LEASABLE AREA Gross Leasable Area shall mean the total gross floor area designed for tenant occupancy and exlusive use, including basements, mezzanines and upper floors if any; expressed in square feet and measured from the centre line of joint partitions and from outside wall faces. 2.45.1 LOADING SPACE, BUS Bus'Loading Space shall mean a minimum area of 400 square feet, having a minimum perpendicular width of 12 feet. 2.55.1 PARKING AREA A Parking Area shall mean one or more parking spaces, including; related aisles, for the parking or storage of vehicles. 2.55.2 PARKING LOT Parking Lot shall mean a lot or portion thereof privided for the parking of motor vehicles accessory or incidental to the main use. 2.75.2 VEFICLE Vehicle includes a motor vehicle, trailer, traction engine, farm tractor, road-building machine and any vehicle drawn, propelled, or driven by any kind of power. 2.80 YARD REQUIRED Required Yard for parking purposes shall mean the minimum main building yard setback from the property line reqaired by the zone in which the property is located and not necessarily the distance between the property line and any building or structure thereon. 2. That sub,jsection 2.45 be and the same is hereby deleted and the following inserted therefore: 2.45 LOADING SPACE Loading Space shall mean an off-street space of a minimum rectangular size of Twenty (20) feet by Ten (10) feet with a vertical clearance of Fourteen (14) feet on the same lot with a building or contiguous to a group of buildings, for Continued 21. -21- 3. 4. the temporary parking of a commercial vehicle while loading or unloading merchandise or materials and which abuts upon a street, lane or other appropriate means of access. That subsection 2.57 be and the same is hereby deleted and the following inserted therefore: 2.57 PARKING SPACE Parking Space shall mean a usable and accessible area of not less than 200 square feet, having a minimum perpendicular width of 9 feet, excluding aisle space and driveways to the parking lot, for the temporary parking of a vehicle. 2.57.1 PARKING SPACE, BUS Bus Parking Space shall mean an accessible area of not less than 400 sq.ft., having a minimum perpendicular width of 10 feet, excluding aisle space and driveways to the parking lot, for the temporary parking of a bus. 2.57.2 PARKING SPACE, WATERFRONT A Waterfront Parking Space (vehicular) shall mean an accessible area of not less than 300 square feet, exclusive of driveways or aisles, for the temporary parking or storage of vehicles with trailers.
