HomeMy WebLinkAboutBy-law 42/74THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER, A by-law of the Corporation of the Town of Pickering to provide for the payment of parking fines at the Town Office. WHEREAS by-laws were enacted by the Council of the Township of Pickering, to which the Corporation of the Town of Pickering is successor, which set out certain areas in the Town of Pickering where parking is prohibited; AND WHEREAS Section 354 para. 107 (a) of The Municipal Act, R.S.O. 1970, Chapter 284, as amended, permits establishment of an expeditious procedure for the voluntary payment of penalties out of court; AND WHEREAS it is deemed advisable that violaters should be able to pay parking fines at the Town Office; NOW THEREFORE the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The fine for a violation of parking in any area where parking is prohibited in the Town of Pickering shall be $5.00 (Five Dollars) if such fine is paid at the Town Office within 5 (five) days of the date of the violation. Saturdays, Sundays and holidays shall be excluded when completing the 5 (five) day period. 2. If after a period of 5 (five) days (Saturdays, Sundays and holidays excluded) the fine has not been paid at the Town Office, the Chief of Police or his Deputy of the Durham Regional Police Department shall cause a summons to be issued for the Parking Violation that will be issued and served in the manner prescribed for the issuance and service of all summonses that are issued or served by the Durham Regional Police Department. 3. The Durham Regional Police Department shall use Durham Regional Parking Violation Tag Form which shall consist of one original and two carbon copies which shall be numbered consecu- tively from 1 (one). The original shall be retained by the officer issuing the Tag, the First Copy shall be kept on file at the Town Office and the Second Copy shall be placed on the "offending vehicle". 4. A receipt shall be issued to the person paying any such fine at the Town Office. The Town Treasurer shall forward a list of all parking tickets that are paid weekly to the Durham Regional Police Department. - 2 - 5. The Durham Regional Police Department shall furnish the Treasurer with a statement of Parking Violation Tags destroyed or cancelled and Parking Violation Tags on which a summons has been issued on or before the 15th of the month following. 6. The Durham Regional Police Department for the Town of Pickering shall be the sole agency to issue Parking Violation Tags and enforce the parking by-laws of the municipality. 7. That Township of Pickering By-law No. 2604 be and the same is hereby repealed. By-law read a First, Second and Third Time and PASSED this ZZ'ut day of 4AkL 1974. Mayor V V Clerk
