BY-LAW NUMBER
Being a by-law to authorize an
application to the Ontario Municipal
Board for an Order redefining the
Garbage Area for the Town of
Pickering.
WHEREAS by Section 354 (1) 76 of The Municipal Act, R.S.O. 1970,
Council may establish and maintain a system for the collection
and removal of garbage;
AND WHEREAS By-Law Number 2141 of the Corporation of the Township
of Pickering passed on the 27th day of February, 1956, provided
for the creation of a defined area in the South part of the Township
of Pickering for the collection, removal and disposal of garbage,
ashes and other refuse to be carried out by the said Township, the
expenses of such collection, removal and disposal to be defrayed by
imposing a special rate upon all lands within the said garbage area;
AND WHEREAS By-laws 2558, 3073 and 3965 provided for the addition
of certain lands to the said defined area;
AND WHEREAS purs.uant to Section 139 (2) of The Regional Municipality
of Durham Act, the responsibility for the disposal of waste is that
of the Regional Corporation;
AND WHEREAS by virtue of the said Regional Municipality of Durham
Act, a portion of the said lands have been annexed by the Borough
of Scarborough and the Town of Ajax;
AND WHEREAS the Council of the Town of Pickering intends to apply
to the Ontario Municipal Board for an Order redefining the present
garbage area pursuant to the provisions of Section 15 of The
Municipal Act, R. S .O. 1970;

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING ENACTS AS FOLLOWS:
1. That an application be made to the Ontario Municipal Board
for an Order redefining the Garbage Area to include the lands
described in Schedule "A" annexed to this by-law and made part
hereof, such order to provide that the said lands to be
included in such redefined area shall share the cost of collec-
tion and removal of garbage, ashes and other refuse, such cost
to be defrayed by a special mill rate imposed on the land
in the redefined area.
2. This special rate may be recovered in like manner as municipal
taxes.
3. All provisions of by-laws or amendments thereto inconsistent
with the provisions of this by-law are hereby repealed.
By-Law read a first, second and third time and PASSED in open
Council this day of , 1974.
