Being a by-law to amend Restricted Area
By-law 3036 as amended.
WHEREAS By-law 43.66/72 and 4205/72 weir, passed
by the Corporation of the Township of Pickering
to am(°nd the provisions of Restricted Area
By-law 3036, as amended which placed holding
zone on subject land outlined therein;
AND WHI;P.EAS Ontario Municipal Board Approval
was never obtained for By-laws 4166/72 or 4205/72;
AND WHEREAS it is deemed expedient to permit
development to now occur on the lands affected
by By-law 4166/72 and 4205/72;
NOW THEREFORE the Council of the Corporation of
the Town of Pickering hereby enacts as follows;
SECTION 1: SCHEDULES
Schedule "A" and "B" attached hereto with notations
and references shown thereon are hereby declared to be part of
this By-law and are described as follows:

SECTION 2: AREA REST RICTED
The provisions of this By-law shall apply to all lands
enclosed by gray line on Schedule "A" attached hereto.
SECTION 3: GENERAL PROHIBITION
No building or land shall hereafter be used or occupied,
no building or part thereof, shall be erected, moved or structurally
altered, except in conformity with the provisions of this By-law.
SECTION 4: DEFINITIONS
"Coverage" shall mean that percentage of a. property covered
by all buildings including accessory buildings.
"Business Office" shall mean any building in which one or more
persons are employed in the management, direction or conducting
of an agency, business, brokerage, labour or fraternal
organization and shall exclude such uses as retail sale, manufacture,
assembly or storage of goods, or places of assembly and amusement.

SECTION 7: ENFORCEMENT
Any person convicted of a breach of any provision of
this By-law sha1:1 forfeit and pay, at the discretion of the
presiding Justice, , a penalty not exceeding , exclusive of
costs ,the sum of Une Thousand Dollars (5:1,000.00) for each
offence, recoverable under The Summary Convictions Act.
SECTION 6: EFFECTIVE DATE
No part of this By-law shall come into force without
the approval. of the Ontario Municipal Board, Ltrt cubje%.t to
such approval, the By-law shall take effect from the date of
passing thereof.
