U-1ti..i 6- b1-11111 TOWN OF PICKERING BY-LAW ?O Being a restricted area by-law to implement the Official Plan of the Town of Pickering in Part Lot 22, Concession 1, Town of Pickering. NOW THEREFORE the Council of the Corporation of the Town of Pickering enacts as follows: SECTION 1: SCHEDULES v:W;"Aly- Schedules "A", "B", and "C" hereto with notations and refer- ences shown thereon are hereby declared to be part of this by-law and are described as follows: Schedule "A" Liverpool - Faylee Zoning PZap Schedule "B" Standards and Provisions Schedule "C" Building and Structure Set-back Provisions. SECTION 2: AREA RESTRICTED The provisions of this by-law shall apply to all lands enclose. by neavy black line on Schedule "A" hereto. SECTION 3: GENERAL PROHIBITION No building or land shall hereafter be used or occupied, or building or part thereof, shall be erected, moved or structurally altered except in conformity with the provisions of this by-law. SECTION 4: DEFINITIONS "Senior Citizens Apartment" shall mean a building containing more than four (4) dwelling units, each unit having access from an inters}al corr- idor system and with provision being made for ancillary recreational uses within the building, such as a lounge and club facilities, and shall be for occupation by elderly persons, and shall be developed by a public agency, service club, church or any other non-profit organ- ization, the financing of which shall be sponsered by a federal, provincial, or municipal organization,or public subscription or don- ation,or donation thereof. SECTION 5: PROVISIONS The performance standards and provisions as set out on Sche- dule "B" hereto shall apply to the Area restricted by this by-law. SECTION 6: BY-LAW 3036 By-law 3036 as amended is hereby further amended only to the extent necessary to give effect to the provisions of this By-law as it applies to the area set out in Schedule "A" hereto. Definitions and subject matters not specifically dealt with in this By-law shall be governed by the provisions of By-law 3036 as amended. SECTION 7: ENFORCEMENT Any person convicted of a breach of any provision of this By- law shall forfeit and pay, in the discretion of the convicting Piagistrat? a penalty not exceeding (exclusive of costs) the sum of Three Hundred Dollars ($300.00) for each offence, recoverable under The Summary Convictions Act. continued...2 -2- SECTION 8: EFFECTIVE DATE This by-law shall come into force and take effect upon being passed by Council subject to the approval of the Ontario Municipal Board.
