Being a by-law to establish a Municipal
Emergency Control Plan to deal with
emergencies within the Town of Pickering
WHEREAS the Council of the Corporation of the Town of
Pickering may, pursuant to the provisions of section 243 of
The Municipal Act, R.S.O. 1970, chapter 284, pass by-laws for
health, safety, morality and welfare of the inhabitants of
the Town of Pickering;
AND WHEREAS, by its By-law Number 214/74, the Regional
Municipality of Durham enacted the Durham Region Peacetime
Emergency Plan which Plan requires the Town of Pickering to
prepare an emergency plan to form part of the Regional Plan;
AND WHEREAS it is deemed desirable to establish a
municipal emergency control plan;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING ENACTS AS FOLLOWS:
1. In this By-law, the term
(a) "emergency" shall mean a situation or threat of an
impending situation adversely affecting, or that
may adversely affect,
(i) the lives of persons temporarily in or resident
in the Town;
(ii) real or personal property in the Town; or
(iii) any combination of the above,
and which is specifically declared to be an emergency
by the Head of Council or his designate;
(b) "Emergency Control Group" shall mean those persons
designated from time to time as Heads of Departments
of the Town, and their designates;
(c) "Head of Council" shall mean the Mayor of the Town;
(d) "Municipal Emergency Control Plan" shall mean any
plan implemented by the Emergency Control Group
pursuant to this By-law and the Durham Region
Peacetime Emergency Plan; and
(e) "Town" shall mean the Town of Pickering.
2. The Head of Council of the Town may declare any situation or
threat of an impending situation to be an emergency if, in his
opinion, the situation or threat is of such a nature and magnitude
that controlled and co-ordinated response by a number of agencies
under the direction of the Emergency Control Group is or may be
required.
3. (a) In the event that an emergency is declared pursuant to
section 2, then the Emergency Control Group, or as many of its
members as can conveniently assemble in the circumstances, shall
meet at such location and at such time as the Head of Council
shall direct, to prepare and implement a Municipal Emergency
Control Plan.

3. (b) Should the Head of Council, for whatever reason, not be
able to specify to members of the Emergency Control Group a
location or time of meeting as provided in subsection (a), then
in that event the Emergency Control Group shall meet as soon as
possible after the declaration of the emergency at the Town of
Pickering Fire Station located at 1616 Bayly Street, Pickering.
4. In preparing a Municipal Emergency Control Plan, the
Emergency Control Group shall take into consideration, in
addition to any other relevant matters, the following:
(a) the establishment of overall control of emergency
operations;
(b) the establishment of communications with all necessary
municipal and non-municipal agencies;
(c) crowd control and evacuation measures;
(d) the protection of potential sources of danger;
(e) temporary social services;
(f) the assembly and distribution of relevant information
to agencies involved and to the public.
5. Any Municipal Emergency Control Plan prepared by the
Emergency Control Group shall be implemented as the Emergency
Control Group directs.
