Being a By-law to declare that certain land
(Lot 95, Plan 816) is required for the purpose
of the Municipality and to set aside that
property for those purposes
WHEREAS, pursuant to The Municipal Affairs Act (formerly The
Department of Municipal Affairs Act), R.S.O. 1970, c. 118, where
any part of the taxes on improved land in the Municipality remains
unpaid on the 1st day of January in the third year following that
in which the taxes were levied, such improved land vests in and
becomes the property of the Municipality upon registration by the
Treasurer of a tax arrears certificate, subject to a right of
redemption and the interest of the Crown;
AND WHEREAS the Municipality may by by-law declare the land to be
required for municipal purposes at the expiry of such period of
redemption;
AND WHEREAS
(a) the whole of Lot 95, Plan 816, Town of Pickering is unimproved
land in the Municipality upon which taxes levied in 1971, 1972,
1973 and 1974 remained unpaid on the 1st day of January, 1975;
and
(b) the Treasurer registered a tax arrears certified against the
said land as Instrument Number D 1437 on the 23rd day of
January, 1975; and
(c) the period within which the right of redemption might have
been exercised expired on the 24th day of January, 1976; and
(d) the said land has not been redeemed according to law;
NOW THEREFORE the Council of the Corporation of the Town of Pickering
enacts as follows;
1. In this By-law "land" shall mean,
ALL AND SINGULAR that certain parcel or tract of land situate,
lying and being in the Town of Pickering in the Regional Municipality
of Durham and Province of Ontario and being composed of the whole of
Lot 95, according to a Plan registered in the Registry Office for the
Registry Division of Durham (formerly of the County of Ontario) as
Plan 816.

2. It is hereby declared that the land referred to in section 1
hereof is required for municipal purposes and the said land is hereby
set aside for such purposes.
