HomeMy WebLinkAboutBy-law 471/76THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER -7i Being a By-law of the Corporation of the Town of Pickering to authorize the execution of a Working Rights Agreement between the Corporation and The Ministry of the Environment, Block "H", Registered Plan M-1024 (Brock Subdivision) THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. That the Mayor and Administrator-Clerk be authorized to execute a Working Rights Agreement between the Corporation of the Town of Pickering and The Ministry of the Environment with respect to Block "H", Registered Plan M-1024, (Brock Subdivision). Mayor Administrator-Cl k Ministry of the Environment WORKING RIGHTS AGREEMENT RE: York/Durham Provincial Sewage Works Programme All of Block "H", Registered Plan M-1024 Town of Pickering, Regional Municipality of Durham WHEREAS, THE MINISTRY OF THE ENVIRONMENT, (Hereinafter called the "Crown") plans to install a pipeline on lands abutting the above cap- tioned property and within the limits of the Crown's existing easement. AND WHEREAS because of the location of this line within the right of way it is desirable for the contractor to have Working Rights over an additional area to facilitate construction; as outlined in blue on the at- tached sketch; AND WHEREAS the undersigned owner (hereinafter called the "Grantor") of the above captioned property is willing to grant to the Crown the rights requested for and in consideration of the covenants hereinafter mentioned to be kept and performed by the Crown; NOW THEREFORE the parties hereto agree as follows: 1. In consideration of the sum of ONE DOLLAR ($1.00) the Grantor hereby grants to the Crown Working Rights over a portion of the above cap- tioned property comprising an area 100' in width, 795.68' in length, more or less and adjoining the north side of the Crown's right of way. 2. The rights herein granted by the Grantor are granted for the period 1976 - 1977 construction only and for the sole purpose of providing additional working space to the Crown, its employees, agents and contractors for the passage of men, vehicles, supplies and equipment and to stockpile materials. 3. The Crown agrees to restore fences cut or damaged by its operation to a condition as good as existed prior to its entry on the property, and to clean up the property and dispose of all debris resulting from its opera- tions. IN WITNESS WHEREOF the parties have executed and delivered this Agreement as of the YJ1 day of September, 1976.
