HomeMy WebLinkAboutBy-law 419/76THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER Being a By-law of the Corporation of the Town of Pickering to authorize the execution of an Agreement between the Corporation of the Town of Pickering and Cecil Edwin Garrett and Nova Patricia Garrett, with respect to Part Block "A", Plan 331. THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk be authorized to execute an agreement between the Corporation of the Town of Pickering and Cecil Edwin Garrett and Nova Patricia Garrett, with respect to Part Block "A", Plan 331. Mayor Administrator-Clerk y THIS AGREEMENT made in duplicate this day of May, 1976 B E T W E E N: THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town" OF THE FIRST PPRT - and - CECIL EDWIN GARRETT and NOVA PATRICIA GARRETT hereinafter referred to as the "Owner" OF THE SECOND PART WHEREAS the Owner is the owner in fee simple of certain lands and premises more particularly described in Schedule "A" hereto; AND WHEREAS the Owner wishes to deal with those lands and premises in a certain manner; AND WHEREAS the Owner is therefore required by Decision, dated the 25th day of March, 1976, of the Committee of Adjustment of the Town of Pickering to enter into a certain agreement or agreements with the Town; NOW THEREFORE THIS AGREEMENT WITNESSETH THAT, in consideration of mutual benefits, the Parties hereto agree as follows: 1. The lands and premises affected by this agreement are those lands and premises more particularly described in Schedule "A" hereto. 2. No building or buildings will be erected on the lands and premises hereinbefore described until a site plan or plans displaying the information set out in Schedule "B" hereto is or are submitted by the Owner to the Town and approved by it. 3. Upon approval by the Town of any site plan or plans, the proposed buildings and other works shown on the plan or plans shall be erected in conformance with the plan or plans. 4. If construction has not commenced within one year of the date of approval of the plan or plans, the plan or plans shall become null and void and a new site plan or plans must be submitted displaying the information set out in Schedule "B" hereto and must be approved by the Town prior to any construction being commenced. 5. Any works required to be done on Town road allowances shall be done according to the specifications of the Town and subject to the approval of the Town's Director of Public Works or his designate. 6. Only one architect shall be used and employed by the Owner for the development of the lands hereinafter described. 7. The Owner shall comply with any and all zoning require- ments in force at any time and pertaining to the area within which the lands hereinbefore described are situate, especially but not necessarily limited to the requirements of By-law 2511, as amended. - z - IN WITNESS WHEREOF hereto affixed its corporate duly authorized officers and "Owner" herein have hereunto SIGNED, SEALED AND DELIVERED the Party of the First Part has seal attested by the hands of its the persons referred to as the set their hands and seals. This agreement and everything contained herein shall enure to the benefit of and be binding upon the Parties hereto and their successors and assigns. SCHEDULE "A" ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the Town of Pickering in the Regional Municipality of Durham (formerly the Township of Pickering in the County of Ontario) and Province of Ontario, and being composed of a portion of Block "A" according to Plan 331 as registered in the Registry Office for the Town of Pickering and more particularly described as follows: Commencing at the north west angle of Block "A" of the said Plan 331; THENCE EAST along the northerly boundary of the said Block "A" of the said Plan 331 a distance of two hundred and eight feet (208'); THENCE SOUTH parallel to the westerly boundary of the said Block "A", Plan 331 a distance of fifty-six feet (56'); THENCE WESTERLY in a straight line a distance of two hundred and eight feet (208') more or less to a point in the westerly boundary of Block "A" Plan 331 distant fifty-two feet six inches (52'6") from the north west angle of the said Block "A" Plan 331; THENCE NORTH along the westerly boundary of the said Block "A" Plan 331 to the place of beginning. TOGETHER WITH a right of way over and the right to use for park purposes as a recreation ground and for bathing purposes (in common with other persons entitled thereto) the whole of the following lands, that is to say: Block "A" and "B" as shown on Plan 175, as amended by Plans 272 and 273, and the shore line between the said Blocks and the water's edge from time to time of Lake Ontario. TOGETHER with a right of way (in common with other persons entitled thereto) over Blocks "D" as shown on said Plan 270, as amended by Plans 272 and 273, and Blocks "E", "F" and "C" as shown on said Plan 175, as amended by Plan number 272. TOGETHER WITH a right of way (in common with other persons entitled thereto) over Blocks "L" and "M" as shown on Plan 311 registered in the said Registry Office. TOGETHER WITH a right of way (in common with other persons entitled thereto) over Blocks "N", "O", "P", "q" and "P." as shown on Plan 331 registered in the said Registry Office. I I SCHEDULE.
