Being a by-law to authorize the execution
of a lease agreement between the Durham
Board of Education and The Corporation of
the Town of Pickering to obtain the use
of the Greenwood School House for the
Pickering Museum Board
WHEREAS by Resolution 176/75 the Council of the
Corporation of the Town of Pickering adopted a recommendation
of the Executive Committee being Item 16, meeting of
November 24, 1975, that the Town of Pickering enter into a
lease agreement with the Durham Board of Education to obtain
the use of the Greenwood School House for the Pickering Museum
Board;
NOW THEREFORE the Corporation of the Town of Pickering
hereby enacts as follows:
1. That the Mayor and Clerk be authorized
to execute a lease agreement between the
Durham Board of Education and The
Corporation of the Town of Pickering to
obtain the use of the Greenwood School
House.

(hereinafter called the "Board")
OF THE FIRST PART

THE CORPORATION OF THE TOWN OF PICKERING
(hereinafter called the "Town")

W I T N E S S E T H
1. In consideration of the rents reserved and the covenants
it
i'herein contained on the part of the Town, the Board hereby leases

Ito the Town certain premises more particularly described as the
jldetached building located in the north-east section of the Valley

I,iView School Site and generally known as the Greenwood Public School,
the original school on the site, for a term of three (3) years
commencing the first day of May, 1976 at a rent of one ($1.00)

Ildollar per year, payable in advance on the first day of May in
,:each and every year during the said term.

Land associated with the premises to be leased is limited'
,Ito the area between the said building and the public road to the

feast, and north of the Valley View School driveway.
12. TOWN'S COVENANTS

The Town covenants with the Board:
(a) To pay rent;
(b) To pay all taxes, rates, duties and assessments
whatsoever, whether municipal, parliamentary or
otherwise, now charged or hereafter to be charged
upon the premises or upon the Board in account
thereof, including taxes for local improvements
or works assessed upon the property benefited
thereby;
(c) To repair;

(d) To allow the Board to enter and view the state of
repair; to make all reasonable repairs according to
notice in writing;
(e) Not to assign or sublet without leave;
(f) Not to carry on, upon the premises, any business that
may be deemed a nuisance;
(g) Not to make any additions or alterations to the
building without the prior written approval of the
Board;
(h) To maintain the premises in a clean and tidy condition;
(i) To maintain the building on the premises at its sole
expense and to pay all costs in connection therewith,
and all costs of its operation for the purposes of
the Town;
(j) To leave the premises in good repair;
(k) To indemnify and save harmless the Board against and
from all loss, costs and damages which the Board may
suffer, incur or be or become liable for by reason of
any use, occupation or condition of the demised
premises during the term hereby granted;
(1) To keep the building or buildings on the premises
insured in the names and for the benefit of the Board
and the Town as their respective interests may from
time to time appear against loss or damage by fire,
and all casualties normally covered by a standard
fire insurance policy with broad extended coverage
in an amount not less than the actual cash value from
time to time of the building or buildings on the
demised premises and to deliver to the Board whenever
required satisfactory evidence of such insurance and
of renewal from time to time thereof;

3. The Parties agree that the Board may re-enter the
premises for non-payment'of rent or non-performance of covenants.
4. The Parties further agree that, where the premises
become vacant and so remain for a period of 30 days, it shall be
presumed that the Town has abandoned the premises and the Board
may re-enter and take immediate possession of the premises.
5. The Board covenants with the Town for quiet enjoyment.
IN WITNESS WHEREOF the parties hereto have hereunto
affixed their corporate seals duly attested by the hands of their
proper officers in that behalf.
