HomeMy WebLinkAboutBy-law 387/76THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 3 $ -7 1 1-7 I Being a by-law to authorize the execution of an agreement between the Corporation of the Town of Pickering and Pitney Bowes of Canada Ltd./Pitney Bowes du Canada Ltee. with respect to the purchase of Parts 2 and 3, Plan 40R-2638, Town of Pickering WHEREAS, pursuant to the provisions of subsection 1 of section 336 of The Municipal Act, R.S.O. 1970, chapter 284, the Council of the Corporation of the Town of Pickering may pass by-laws for acquiring land required for the purposes of the Corporation; AND WHEREAS, pursuant to the provisions of subsection 3 of section 336 of that Act, if it appears that a larger quantity of land than is required can be more reasonably and more advantageously acquired, the Council may acquire such larger quantity; AND WHEREAS the Corporation of the Town of Pickering wishes to acquire Parts 2 and 3 on Plan 40R-2638, Town of Pickering, for road purposes; NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby enacts as follows: 1. The Mayor and Clerk are hereby authorized to execute an agreement between the Corporation of the Town of Pickering and Pitney Bowes of Canada Ltd./Pitney Bowes du Canada Ltee. with respect to the purchase by the Town of Parts 2 and 3 on Plan 40R-2638, Town of Pickering. '?_ THIS INDENTURE OF AGREEMENT made as of the 10th day of March, 1976. ; B E T W E E N: PITNEY BOWES OF CANADA LTD. PITNEY BOWES DU CANADA LTEE. hereinafter called "Pitney Bowes" OF THE FIRST PART and THE CORPORATION OF THE TOWN OF PICKERING, hereinafter called "Pickering" OF THE SECOND PART I j WHEREAS Pitney Bowes will shortly be receiving a con- . j veyance of Parts 2 and 3, Plan 40R-2638, Town of Pickering from Monarch Marking System, Limited; and WHEREAS Pitney Bowes had planned to erect its new a it plant on said Part 3; and WHEREAS Pickering requires these lands for certain road opening purposes and has requested that said lands be conveyed to it; and WHEREAS Pitney Bowes has agreed to convey said lands to Pickering; and WHEREAS it is considered desirable that these agree- ' l ments be reduced to writing; NOW THEREFORE THIS INDENTURE WITNESSETH that in con- sideration of the mutual convenants and agreements herein con- tained the parties hereto mutually agree as follows: l 1. Pitney Bowes will sell to and Pickering will buy from Pitney Bowes, Parts 2 and 3 of Plan 40R-2638 Pickering, consist- ing of 6.054 acres at and for a price of $124,500.00. ; IN WITNESS WHEREOF the parties hereto have hereunto executed this agreement under their corporate seals and signed ; ?I - 2 - by their proper officers duly appointed.
