HomeMy WebLinkAboutBy-law 900/78THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 900/78 Being a Restricted Area By-law to amend Restricted Area By-law 3036, as amended, to implement the official Plan of the Town of Pickering District Planning Area, Region of Durham, in Lot 13, Plan 489, Town of Pickering. WHEREAS the Council of the Corporation of the Town of Pickering deems it desirable to permit an east side yard setback of 0.216 m on Lot 13, Plan 489; AND WHEREAS an amendment to By-law 3036 is therefore deemed necessary; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: SECTION 1: BY-LAW 3036. By-law 3036, passed by the Council of the Corporation of the Township (now Town) of Pickering on the 3rd day of August, 1965, and approved by the Ontario Municipal Board on the 7th day of October, 1966 and amended from time to time is hereby further amended to the extent necessary to give effect to the provisions of Sections 2 and 3 hereof. SECTION 2: TEXT AMENDMENT Section 9 of the said By-law is hereby amended by adding thereto the following subsection: 9.3 Exceptions 9.3.1 Lot 13, Plan 489 Notwithstanding the provisions of Section 9.2 hereof, being Lot 13, Plan 489, the property designated as R3-1 on Schedule "A" hereto, is permitted a minimum easterly side yard setback of 0.216 m (0.71 feet) in relation to the structure existing on the property on the date of passing of this By-law. SECTION 3: SCHEDULE "A" AMENDMENT Schedule "A" to By-law 3036, as amended, is hereby further amended by altering from "R3" to "R3-1" the zone designation of the lands designated R3-1 on Schedule "A" attached hereto. SECTION 4: EFFECTIVE DATE No part of this By-law shall come into force without the approval of the Ontario Municipal Board but, subject to such approval, this By-law shall take effect from the day of passing thereof.
