HomeMy WebLinkAboutBy-law 898/78THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 898/78 Being a by-law to request the Minister of Housing to make an order under The Planning Act, section 29a, to validate the title to certain lands in Lot 10, Concession 5, Pickering WHEREAS, pursuant to the provisions of section 29a of The Planning Act, R.S.O. 1970, c.349, as amended by S.O. 1973, c. 168, the Minister of Housing may, by order, provide that the contravention before March 19th, 1973 of section 29 of the Act, or a predecessor thereof, does not have and shall be deemed never to have had the effect of preventing the convey- ance or creation of any interest in the land described in the order; AND WHEREAS no such order shall be made by the Minister unless the municipal council, by by-law, requests the Minister to do so; AND WHEREAS Mr. Jack Jacobsen has applied to the Town for such a by-law with respect to certain lands in Lot 10, Conces- sion 5, Pickering; NOW THEREFORE the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The Minister of Housing is hereby respectfully requested to make an order, pursuant to the provisions of subsec- tion 1 of section 29a of The Planning Act, thereby vali- dating the title of Mr. Jack Jacobsen to those lands more particularly described as follows: All and singular that certain parcel or tract of land and premises situate, lying and being in the Town of Pickering in the Regional Municipality of Durham (for- merly the Township of Pickering in the County of Ontario) and Province of Ontario and being composed of that part of Lot 10, Concession 5, described as follows: PREMISING the easterly limit of Greenwood Road is established by Instrument No. 2415 (By-Law 309) to have a bearing of North 19 degrees 1 minute 30 sec- onds West and relating all bearings herein thereto; COMMENCING at a point in said Lot 10 which may be located as follows: BEGINNING at a point in the northerly limit of said Lot distant 145.20 feet easterly thereon from the northwest angle of said Lot; THENCE North 73 degrees 38 minutes East and continu- ing along the said northerly limit a distance of 15.54 feet to an angle therein; THENCE North 70 degrees 54 minutes East and continuing along the said northerly limit a distance of 184.46 feet to a point; THENCE South 21 degrees 51 minutes 30 seconds East a distance of 17.02 feet to a point being the point of commencement of the hereinafter described parcel of land; THENCE continuing south 21 degrees 51 minutes 30 seconds East a distance of 202.20 feet to an iron bar planted; -2- THENCE South 70 degrees 54 minutes West a distance of 95.84 feet to an iron bar planted; THENCE North 19 degrees 01 minute 30 seconds West a distance of 202.12 feet to a point; THENCE North 70 degrees 54 minutes East 85.00 feet more or less to the point of commencement.
