HomeMy WebLinkAboutBy-law 874/78THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 874/78 Being a By-law to authorize the execution of a Release Agreement between the Cor- poration of the Town of Pickering and Robert Byers respecting a Demolition Agreement pertaining to Lot 32, Plan 816. WHEREAS the Corporation of the Town of Pickering and Robert Byers entered into an Agreement dated April 21, 1975, and registered in the Registry Office for the Registry Division of Durham on May 29, 1975 as Instrument No. D7748; AND WHEREAS it is now deemed expedient to release Robert Byers from the provisions of the said Agreement; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release Agreement in the form attached hereto as Schedule "A" be- tween the Corporation of the Town of Pickering and Robert Eyers respecting a Demolition Agreement concerning Lot 32, Plan 816. BY-LAW read a first, second and third time and finally passed this 8th day of August , 1978. B E T W E E N: THE CORPORATION OF THE TOWN OF PICKERING hereinafter called the "Town" OF THE FIRST PART - and - ROBERT BYERS hereinafter called the "Owner" OF THE SECOND PART WHEREAS, by Instrument dated April 21, 1975 and regis- tered May 29, 1975 in the Registry Office for the Registry Division of Durham as No. D7748, the Parties hereto entered into a certain agreement respecting the lands affected here- by; AND WHEREAS the obligations of each Party, as set out in that agreement have been complied with to the satisfaction of the other Party; AND WHEREAS it is therefore deemed expedient that each Party release the other from the terms and conditions of that agreement; NOW THEREFORE this indenture witnesseth that in consideration of the mutual covenants and agreements herein contained and subject to the terms and conditions hereinafter set out, the Parties hereto agree as follows: 1. The lands and premises affected hereby are those lands and premises more particularly described in Schedule "A" hereto. 2. The Town and the Owner do hereby release, remise and forever discharge each other, their respective heirs, executors, administrators, successors and assigns of and from any and all claims of any nature or kind what- soever which either may have had or may have, now or at any time in the future, against the other, for any matter, cause or thing arising or in any way resulting from the terms and conditions of an agreement between the Town and the Owner which agreement is dated April 21, 1975 and was registered May 29, 1975 in the Regis- try Office for the Registry Division of Durham as Instrument No. D7748. 3. This agreement and everything herein contained shall enure to the benefit of and be binding upon the res- pective heirs, executors, administrators, successors and assigns of the Parties hereto. IN WITNESS WHEREOF the Party of the First Part has hereunto affixed its corporate seal, attested by its authorized - z - officers, and the Party of the Second Part has hereunto af- fixed his hand and seal.
