HomeMy WebLinkAboutBy-law 836/78THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 836/78 Being a By-law to authorize the execution of a Site Plan Agreement between the Cor- poration of the Town of Pickering and David R. Clements and Bessie Clements with respect to Part Lot 15, Plan 230 and Part Lot 128, Plan 350, Pickering (LD 73-5/78) WHEREAS pursuant to the provisions of a Decision dated April 10, 1978 of the Land Division Committee of the Regional Municipality of Durham an Agreement is required to be entered into respecting the severance of Part Lot 15, Plan 230 and Part Lot 128, Plan 350, Pickering; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Site Plan Agreement in the form attached hereto as Schedule "A" between David R. Clements and Bessie Clements and the Corporation of the Town of Pickering respecting Part Lot 15, Plan 230 and Part Lot 128, Plan 350, Pickering (LD 73-5/78). D:_ THIS IS SCHEDULE "A" TO BY-LAW NUMBER 836/78 THIS AGREEMENT made in duplicate this 19th day of June, 1978. B E T W E E N: THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town" - and - OF THE FIRST PART DAVID R. CLEMENTS AND BESSIE CLEMENTS hereinafter collectively referred to as the "Owner' OF THE SECOND PART WHEREAS the owner is the owner in fee simple of certain lands and premises more particularly described in Schedule "A" hereto; AND WHEREAS the Owner wishes to deal with those lands and premises in a certain manner; AND WHEREAS the Owner is therefore required by Decision, dated the 10th day of April, 1978, of the Land Division Committee of the Regional Municipality of Durham to register on title that no additional lots be created on the retained lands except by Plan of Subdivision; NOW THEREFORE THIS AGREEMENT WITNESSETH THAT, in consideration of mutual benefits, the Parties hereto agree as follows: 1. The lands and premises affected by this agreement are those lands and premises more particularly described in Schedule "A" hereto. 2. The Owner hereby agrees that he shall not make, nor cause to be made, any application to any relevant authority for an approval or consent to create additional lots upon the lands affected hereby except by means of an application to subdivide the said lands by reference to a registered plan of subdivision pursuant to the provisions of The Planning Act, R.S.O. 1970, c. 349, as amended from time to time, or any successor thereto. 3. This Agreement and enure to the benefit of and their heirs, successors and everything contained herein shall be binding upon the Parties hereto, assigns. IN WITNESS WHEREOF the Party of the First Part has hereto affixed its corporate seal attested by the hands of its duly authorized officers and the persons comprising the - 2 - Party of the Second Part have hereto affixed their respective hands and seals. Clements Bessie Clements s" 1 SCHEDULE "A" ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the Town of Pickering, in the Regional Municipality of Durham and Province of Ontario and being composed of that part of Lot 15, according to a Plan registered in the Registry Office for the Registry Division of Durham as Plan Number 230 and that part of Lot 128 according to a plan registered in the said office as Plan Number 350, which parts are together designated as Part 1 on a Plan of Survey of record registered in the said office as Plan Number 40R-4262. r ro H H H N•Jo C X F ?
