HomeMy WebLinkAboutBy-law 813/78THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 813/78 Being a By-law to adopt Amendment Number 34 of the Official Plan for the Town of Pickering Planning Area, Region of Durham. WHEREAS an Official Plan for the Town of Pickering District Planning Area, Region of Durham, was prepared by the Planning Board of the former Township of Pickering, in accordance with Section 12 of The Planning Act, R.S.O. 1970, Chapter 349; AND WHEREAS the Council of the Town of Pickering deems it expedient to amend the said Official Plan in accordance with the provision of The Planning Act and The Regional Municipal- ity of Durham Act, S.O. 1973, Chapter78; AND WHEREAS Council has examined Amendment Number 34 of the said Official Plan and it is deemed expedient to adopt same; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. That the said Amendment Number 34 of the Town of Pickering District Planning Area, Region of Durham Official Plan is hereby adopted and recommended to the Council of the Regional Municipality of Durham for approval and forward- ing to the Minister of Housing for his approval and; 2. That the Mayor and Clerk be authorized and directed to execute on behalf of the Council of the Town of Pickering and area municipal certification in the form attached hereto as Schedule "A". By-law read a first, second and third time and PASSED this 15th day of May 1978. Clerk SCHEDULE "A" BY-LAW # 813/78 AMENDMENT NNA Bml, 34 TO 'T'ill' OFFICIAL PLAN OF Tiff: I•'ORI-IER PLANNING AREA 01' TI1R TOWNSHIP OF PICKIL:RI-NG NOW PART OF TILE DURILUI PLANNING AREA U OFFICIAL PLAN FOR THAT PORTION OF THE DURHAM PLANNING AREA WHICH ON THE 31ST DAY OF DECEMBER 1973 COMPRISED THE TOWNSHIP OF PICKNRING PLANNING AREA ADIP;NUM1:NP NUMBER 3.1 The attached explanatory text, table and maps, constituting Amendment Number 34 to the official Plan for that portion of the Durham Planning Area which on the 31st day of December, 1973 comprised the Township of Pickering Planning Area, was recommended to the Regional Municipality of Durham by By-law Number oY the Council of the Town of Pickering passed on the day of 197 under the provisions of Sections 60 and 61 of Bill 162 - an Act to establish The Regional Municipality of Durham. MAYOR Corporate Seal of Municipality CLERK U PURPOSE This Amendment is to amend Official Plan Map Schedules IIC and IID Sewers and Water Staging and the "Summary of Land Use Areas and Staging", in conjunction with a Neighbourhood P1an,to provide for an integrated Residential development. TnCATION This Amendment pertains to lands hereafter referred to as "the subject lands" which are generally bounded by Finch Avenue to the north, Whites Road to the Blest and the recently developed "Amberlea" subdivision to the East and South, shown on the ?5p Schedules attached hereto. BASIS The subject ]ands constitute the only major area of undeveloped lands remaining in Lot 23, Concession ]. Development of these lands at this time would be a logical completion of the "Amberlea" subdivision. It is proposed that development of the suhjcct lands be by Plans of Subdivision and infilling severances to be contingent upon satisfactory arrangements with Council regarding the provision of all services, including provision of Trunk and Sub-trunk Sewers and availability of sewanc Treatment Plant ?./ capacity. To provide for this, it is advocated that Map Schedules TIC and IID be amended by deleting the subject lands from Stage V and incorporating theca into Stage II. The resultant modifications to the Summary of Land Use Areas and Staging embodied in this Amendment and the Neighbourhood Plan are attached as Appendices "A" and "B" Amendment. POLICIES INCOPPORATCD IN'' AMJ:.NDMENT (a) Schedules SIC and IID (Sewers-Plater and Staging) of the Official Plan shall be amended by the deletion of the subject lands from Stage V and their incorporation into Stage IT -- as shown on the attached Map being Schedule "A" to this Amendment. U (b) The "Summary of Land Use Areas and Staging" shall be amended to provide for the proposals embodied in Policy (a) above, and is attached as Appendix "A" to this Amendment. IMPLEMENTATION This Amendment shall be implemented by the Registration of Plans of Subdivision and infilling severances and the enactment of Amendments from time to time to Restricted Area By-law [Number 3036 to provide for the uses laid down in the Ncighhourhood flan,rind in accordance with Municipal servicing arrangements to be made with respect to this development. INTERPRETATION. The provisions of the Official Plan to time royardinq the interpretation apply with regard to this Amendment event of discrepancy, the provisions shall prevail.
