BY-LAW NO. 796/78
Being a By-Law to authorize the execution
of a Working Rights Agreement between the
Ministry of the Environment and the
Corporation of the Town of Pickering
respecting a portion of the York/Durham
Sewage System (Part Block "A", Plan M-106).
WHEREAS the Corporation of the Town of Pickering is the owner
of certain lands being part of Block "A", Plan M-106;
AND WHEREAS the Ministry of the Environment has requested
working rights over those lands to facilitate the construction and
installation of a pipeline on lands abutting the lands referred to
above;
NOW THEREFORE the Council of the Corporation of the Town of
Pickering HEREBY ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a
Working Rights Agreement, in the form attached hereto
as Schedule "A", between the Corporation of the Town
of Pickering and the Ministry of the Environment
(Ontario) respecting a part of Block "A", Plan M-106
comprising an area of 1.74 acres as outlined in the
easement sketch incorporated in the Agreement.
BY-LAW read a first, second and third time and finally passed this
17th day of April , 1978.

WORKING RIGHTS AGREEMENT
Re: Part of Block "A", Registered Plan M-106

WHEREAS, THE MINISTRY OF THE ENVIRONMENT, (hereinafter called the "Crown")
plans to install a pipeline on lands abutting the above captioned property and within
the limits of the Crown's existing easement.
AND WHEREAS because of the location of this line within the right-of-way
it is desirable for the contractor to have Working Rights over an additional area
to facilitate construction;
AND WHEREAS the undersigned owner (hereinafter called the "Grantor") of
the above captioned property is willing to grant to the Crown the rights requested
for and in consideration of the covenants hereinafter mentioned to be kept and per-
formed by the Crown;
NOW THEREFORE the parties hereto agree as follows:
1. In consideration of the sum of ONE ($1.00) Dollar the Grantor hereby grants
to the Crown Working Rights over a portion of the above captioned property comprising
an area of 1.74 acres *_ and adjoining the north side of the Crown's right-of-way.
2. The rights herein granted by the Grantor are granted for 1978 construction
only and for the sole purpose of providing additional working space to the Crown,
its employees, agents and contractors for the passage of men, vehicles, supplies
and equipment and to stockpile materials.
3. The Crown agrees to restore fences cut or damaged by its operation to a
condition as good as existed prior to its entry on the property, and to clean up
the property and dispose of all debris resulting from its operations, and to restore
the surface thereof to a condition equal to that in which the property was found
prior to commencement of construction.
IN WITNESS WHEREOF the parties have executed and delivered this Agreement
as of the day of , 1978.
