HomeMy WebLinkAboutBy-law 999/79THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 999/79 Being a Restricted Area By-law to amend Restricted Area By-law 2511, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, on Part of Lots 64 and 65, Plan 350, in the Town of Pickering. WHEREAS the Council of the Corporation of the Town of Pickering deems it desirable to permit the establishment of a private non-residential school on the subject lands, being part of Lots 64 and 65, Plan 350, in the Town of Pickering; AND WHEREAS an amendment to By-law 2511 is therefore deemed necessary; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. By-law 2511 C By-law 2511, passed by the Council of the Corporation of the Township (now Town) of Pickering on the 5th. day of October, 1960, and approved by the Ontario Municipal Board on the 3rd. day of January 1963, and amended from time to time, is hereby further amended to the extent necessary to give effect to the provisions of this By-law. 2. Text Amendment "(1) Sections 2.67 and 2.68 of By-law 2511 are hereby revoked and the following substituted therefor: 2.67(a) "Public School" shall mean, (i) a school under the jurisdiction of a board of education which board is es- tablished pursuant to The Education Act, 1974, or any successor thereto; (ii) a college of applied arts and technology established pursuant to The Ministry of Colleges and Universities Act, 1971, or any successor thereto; (iii) a university eligible to receive provin- cial funding from the Minister of Colleges and Universities, pursuant to The Ministry of Colleges and Universities Act, 1971, or any successor thereto. 2.67(b) "Private Non-Residential School" shall mean a school which is maintained for educational or religious purposes but shall not include any other school defined herein. 'OWN OF. 2.67(c) "Private Residential School" shall mean a ICKERING school which is maintained for educational or religious purposes and which includes 1PPROVED accessory residential facilities but shall iT0 50VM not include any other school defined herein. /continued A B 2.67 (d) "Co :crCial School" Hha'_1 Car. a I operates for Cain or profit anc ray include tine studio of a dancing teacher or music teacher, or an art school, a golf school or any other such school operated for gain or profit, but shall not include any other school defined herein. 2.67(e) "Day Nursery" shall mean lands and premises duly licensed pursuant to the provisions of The Day Nurseries Act, or any successor thereto, and for use as a facility for the daytime care of children. Text Amendment Section 10 of the said By-law as amended is hereby further amended by adding thereto the following subsection: 10.3.2 Part of Lots 64 and 65, Plan 350 Notwithstanding the provisions of Sections 10.1 or 10.2 hereof, the land designated 'R4-1' on Schedule "I" to By-law 999/79 shall be used only in accordance with the following provisions: Uses Permit In addition to the uses permitted in R4 One-Family Detached Fourth Density Zones, the lands designated R4-1 on Schedule "I" to By-law 999/79 may be used for a private non-residential school. Zone Requirements (i) No person-shall,-within the lands designated R4-1 on Schedule "I" to By-law 999/79use any lot or erect, alter or use any building or structure except in accordance with-the provisions of Section 10.2 hereof. (9i) Notwithstanding the provisions of Section 10.2.6, no person shall, within the lands designated R4-1 on Schedule "I" to By-law 999/79 use any lot or erect, alter or use any building or structure for any non- residential purpose except in accordance with the following: (a) LOT COVERAGE (maximum) 16 percent (b) BUILDING HEIGHT (maximum) 1 storey 3 Schedule "A" Amendment Schedule "A" to By-law 2511, as amended, is hereby further amended by altering from 'R4' to 'R4-1' the zone designation of the land designated R4-1 on Schedule "I" to this By-law, and located in Part of Lots 64 and 65, Plan 350, in the Town of Pickering. 4. 11 Effective Date No part of this By-law shall come into force without the approval of the Ontario Municipal Board, but, subject to such approval, this By-law shall take effect from the day of passing hereof.
