HomeMy WebLinkAboutBy-law 977/79THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 977/79 Being a by-law to amend By-Law 733/77, licensing, regulating and governing taxi- cab and limousine drivers, owners and brokers. WHEREAS, pursuant to the provisions of paragraph 1 of section 377 of The Municipal Act, R.S.O. 1970, c.284, the Town of Pickering enacted By-Law 733/77 on December 19th, 1977 to provide for the licensing, regulating and governing of taxicab and limousine drivers, owners and brokers, and for establishing the rates and fares to be charged by the owners or drivers of such vehicles for the conveyance of goods or passengers, either wholly within the municipality or to any point not more than three miles beyond its limits, and providing for collection of such rates or fares and for revoking any such licences; and WHEREAS, section 377 of the said Act has been amended, by the addition thereto of paragraph lb, by section 6 of The Municipal Amendment Act, 1978, S.O. 1978, c.101, such that a by-law enacted pursuant to the provisions of paragraph 1 of the said section 377 may be made to apply to the owners and drivers of taxicabs and limousines engaged in the convey- ance of goods or passengers from any point within the muni- cipality to any point outside the municipality, subject to certain exceptions; and WHEREAS it is deemed expedient, as a result of the above- mentioned amendment and for other reasons, to amend the said by-law; NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. Clause (g) of section 1 of By-Law 733/77 is hereby repealed and the following substituted therefor: (g) "Officer" shall mean a Municipal Law Enforcement Officer or Assistant Municipal Law Enforcement Officer appointed by the Council; 2. The said By-Law is hereby amended by adding thereto the following section: la. This By-Law applies to, TOWN OF PICKERING APPROVED S.iTO FORM (a) the owners and drivers of taxicabs engaged in the conveyance of goods or passengers from any point within the municipality to, (i) any other point within the municipality, or (ii) any point outside the muni- cipality, - 2 - to an airport owned and operated by the Crown in right of Canada situate outside the municipality by a taxicab bearing a valid and subsisting plate issued in respect of such airport under The Govern- ment Airport Concession Operations Regulations made under the Depart- ment of Transport Act (Canada), (b) the owners and drivers of limousines engaged in the conveyance of goods or passengers from any point within the municipality to, (i) any other point within the municipality, or (ii) any point not more than three miles beyond the limits of the municipality, and, (c) all taxicab and limousine brokers accepting bookings for any taxicabs or limousines, as the case may be, to whose owners and drivers this By-Law applies. 3. Section 14 of the said By-Law is hereby repealed. 4. Section 20 of the said By-Law is hereby repealed and the following substituted therefor: 20. Every driver shall charge, for any trip, the fare shown on the taximeter together with any applicable additional charges authorized by Schedule "B" hereof. 5. Subsection 1 of section 37 of the said By-Law is hereby repealed and the following substituted therefor: (1) Every taxicab or limousine broker shall, (a) maintain an office in the Town; (b) carry on the business of accepting calls for, directing calls to, and dispatching taxicabs or limousines, as the case may be, at all times that the broker's licence is not under suspension. 6. This By-Law shall be effective from and after 12 o'clock midnight, April 30th, 1979. - 3 - BY-LAW read a first, second and third time and finally passed this 2nd day of April , 1979. NO P,4 -7 Mayor
