THE CORPORATION OF THE TOWN OF PICKERING
BY-LAW 971/79
Being a Restricted Area By-law to amend
Restricted Area By-law 3036, as amended,
and to implement the Official Plan of the
Town of Pickering District Planning Area,
Region of Durham, in Part Lot 33,
Concession 1, in the Town of Pickering.
WHEREAS the Council of the Corporation of the Town of
Pickering deems it desirable to permit the establishment
of a day nursery on the subject lands, being part of Lot
33, Concession 1, in the Town of Pickering;
AND WHEREAS an amendment to By-law 3036 is therefore
deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN
OF PICKERING HEREBY ENACTS AS FOLLOWS:
1. BY-LAW 3036
By-law 3036, passed by the Council of the Corporation
of the Township (now Town) of Pickering on the 3rd day of
August, 1965, and approved by the Ontario Municipal Board
on the 7th day of October, 1966, and amended from time to
time, is hereby further amended to the extent necessary to
give effect to the provisions of Sections 2 and 3 hereof.
2. TEXT AMENDMENT
(a) Section 2 of By-law 3036, as amended, is hereby
further amended by adding thereto the following
subsection:
2.16.2 DAY NURSERY
"Day Nursery" shall mean lands and premises duly
licenced pursuant to The Day Nurseries Act, or any
successor thereto, for use as a facility for the
daytime care of children.
(b) Section 17 of the said By-law as amended is hereby
further amended by adding thereto the following
subsection:
17.4.2 PART LOT 33, CONCESSION 1
(i) Notwithstanding the provisions of subsection
17.1 hereof, the lands designated 'G-1' on
Schedule "I" to By-law 971/79 and located
in part of Lot 33, Concession 1, in the Town
of Pickering, may be used for the purpose of
a day nursery.
(ii)
Any building located on the lands designated
'G-1' on Schedule "I" to By-law 971 79 and
located in part of Lot 33, Concession 1, Town
of Pickering, and used solely for the purpose
of a day nursery must be in accordance with
the standards and provisions of Schedule "II"
to By-law971/79

3. SCHEDULE "A" AMENDMENT
Schedule "A" to By-law 3036, as amended, is hereby
further amended by altering from "G" to "G-1" the zone
designation of the lands designated G-1 on Schedule "I"to
By-law 971/79 , and located in part of Lot 33, Concession 1
Town of Pickering.
4. EFFECTIVE DATE
No part of this By-law shall come into effect without
the approval of the Ontario Municipal Board, but subject to
such approval, the By-law shall take effect from the day of
passing hereof.
