'?7 9 4 3 z z- Being A Restricted Area By-law to amend Restricted Area By-law 3036, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, in Part of Lot 18, Concession 1, in the Town of Pickering. WHEREAS the Council of the Corporation of the Town of Pickering deems it desirable to permit the expansion of the garage use presently existing on the subject land; AND WHEREAS an amendment to By-law 3036, as amended, is therefore deemed necessary; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: SCHEDULE "I" Schedule "I" hereto with notations and references shown thereon is hereby declared to be part of this by-law. 2. AREA RESTRICTED The provisions of this by-law shall apply to those lands in Lot 18, Concession 1, Pickering, designated CA3 on Schedule "I" attached hereto. 3. GENERAL PROVISIONS No building, land or part thereof shall hereafter be used, occupied, erected, moved or structurally altered except in conformity with the provisions of this by-law. 4 TOWN OF PIClKEf:Ih7 !,x;, "r+PH .11 0, v? u AS TO FJR : DEFINITIONS (a) "Coverage" shall mean the percentage of lot area covered by all buildings on the lot. (b) "Vehicle Sales or Rental Establishment" shall mean an establishment having as its main use the sale, service, rent or lease of vehicles, and which may include an accessory vehicle repair shop, but shall not include any establishment engaged in the retail sale of motor vehicle fuels. (c) (i) "Yard" shall mean an area of land which is appurtenant to and located on the same lot as a building or structure and is open, uncovered andunoccupied above ground except for such buildings, structures or other uses as are specifically permitted thereon. (ii) "Front Yard" shall mean a yard extending across the full width of a lot between the front lot line of the lot and the nearest wall of the nearest main building or structure on the lot. r continued... page 2 (iii) "Front Yard Depth" shall mean the shortest horizontal dimension of a front yard of a lot between the front lot line and the nearest wall of the nearest main building or structure on the lot. (iv) "Rear Yard" shall mean a yard extending across the full width of a lot between the rear lot line of the lot or, where there is no rear lot line, the junction point of the side lot lines, and the nearest wall of the nearest main building or structure on the lot. (v) "Rear Yard Depth" shall mean the shortest horizontal dimension of a rear yard of a lot between the rear lot line or, where there is no rear lot line, the junction point of the side lot lines, and the nearest wall of the nearest main building or structure on the lot. (vi) "Side Yard" shall mean a yard of a lot extending from the front yard to the rear yard and from the side lot line to the nearest wall of the nearest main building or structure on the lot. (vii) "Side Yard Width" shall mean the shortest horizontal dimension of a side yard of a lot between the side lot line and the nearest wall of the nearest main building or structure on the lot. (viii) "Flankage Side Yard" shall mean a side yard immediately adjoining a street or abutting a reserve on the opposite side of which is a street. (ix) "Interior Side Yard" shall mean a side yard other than a flankage side yard. 5. - PROVISIONS A. Uses Permitted No person shall within the lands designated CA3 on Schedule "I" hereto, use any lot or erect, alter or use any building or structure for any purpose except as follows: (a) vehicle sales and rental establishment B. Zone Requirements (a) No person shall within the lands designated CA3 on Schedule "I" hereto, use any lot or erect, alter or use any building or structure except in accordance with the Drovisions of this subsection. (b) For the purpose of this section, the lot lines flanking Kingston Road (Highway No.2) or an abutting reserve are deemed to be the front lot line, and the lot line flanking Finch Avenue or an abuttino_ reserve is r deemed to be the rear lot line. continued... page 3 (i) FRONT YARD DEPTH (minimum): 15 metres (ii) INTERIOR SIDE YARD WIDTH (minimum): 10 metres (iii) FLANKAGE SIDE YARD WIDTH (minimum): 15 metres (iv) REAR YARD DEPTH (minimum): 10 metres (v) LOT COVERAGE (maximum): 30 percent (vi) BUILDING HEIGHT (maximum): 11 metres (vii) LANDSCAPED OPEN AREA (minimum): 15 percent 6. BY-LAW 3036 (a) By-law 3036, as amended, is hereby further amended only to the extent necessary to give effect to the provisions of this By-law as it applies to the area set out in Schedule "I" attached hereto. Definitions and subject matters not specifically dealt with in this By-law shall be governed by the relevant provisons of By-law 3036, as amended. (b) By-law 481/76, amending By-law 3036, passed by the Corporation of the Town of Pickering on the 27th day of September, 1976, and approved by the Ontario Municipal Board on the 9th day of November, 1976, is hereby revoked. 7. ENFORCEMENT Any person who contravenes any of the provisions of this By-law shall be liable upon conviction thereof to a fine not exceeding $1000.00 for each offence, exclusive of costs, recoverable under The Summary Convictions Act. 8. EFFECTIVE DATE No part of this By-law shall come into force without the approval of the Ontario Municipal board but, subject to such approval, the By-law shall take effect from the date of passing hereof. M1(S) - Storage and Light Manufacturing (Specific), and A - Rural Agricultural CA3 - Commercial Automotive (Vehicles Sale) The purpose of this by-law is to amend the zoning designation on the subject land from the Specific Storage and Light Manufacturing Zone and the Rural Agricultural Zone to a Commercial Automotive (Vehicle Sales) Zone.
