HomeMy WebLinkAboutBy-law 1031/79THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 1031/79 Being a By-Law to authorize the execution of an Agreement between the Corporation of the Town of Pickering and Chiavatti Developments Limited, Remo Chiavatti Limited and Silvio Chiavatti Limited (Relchief Construction Limited) respect- ing Part Lot 69 and Lot 70, Plan 350, Pickering (LD 208-10/78) WHEREAS, by decisions dated June 26th, 1979, the Land Division Committee of the Regional Municipality of Durham approved applications for severance of Part Lot 69 and Lot 70, Plan 350, Pickering, subject to certain conditions, one of which requires that it be registered on title that the balance of the land be developed by plan of subdivision only; and WHEREAS, the most satisfactory manner of fulfilling that condition is the entering into of an Agreement between the applicants and the Town to that effect; NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute an Agreement in the form attached hereto as Schedule "A", between the Corpora- tion of the Town of Pickering and Chiavatti Developments Limited, Remo Chiavatti Limited and Silvio Chiavatti Limited (Relchief Construction Limited) respecting Part Lot 69 and Lot 70, Plan 350, Pickering (LD 208-10/78) BY-LAW read a first, second and third time and finally passed this 30th day of July , 1979. ti a or i Clerk SCHEDULE "A" TO BY-LAW 1031/79 THIS AGREEMENT made in triplicate this 30th day of July, 1979. BETWEEN: CHIAVATTI DEVELOPMENTS LIMITED and REMO CHIAVATTI LIMITED and SILVIO CHIAVATTI LIMITED all Corporations incorporated under the Laws of the Province of Ontario, as partnership property hereinafter called the "Owner" OF THE FIRST PART, - and - THE CORPORATION OF THE TOWN OF PICKERING hereinafter called the "Town" OF THE SECOND PART. WHEREAS, the Owner is the owner of lands being part of Lot 69 and the whole of Lot 70, Plan 350, Pickering, and has applied to the Land Division Committee of the Regional Municipality of Durham for consent to deal with part of the said lands as provided for under Section 29 of The Planning Act, R.S.O. 1970, chapter 349 and amendments thereto; and WHEREAS, the said application has been granted on conditions, including the giving of the within Agreement; NOW THEREFORE, THIS AGREEMENT WITNESSETH, that in consideration of the granting of the said consent to deal with the said lands and other valuable consideration, the Parties hereto agree as follows: 1. The lands affected by this Agreement (hereinafter referred to as the "said lands") are as set out in Schedule "A" hereto annexed. 2. The Owner agrees that there will be no further subdivision of the said lands save and except by Plan of Subdivision pursuant to an applica- tion made under section 33 of The Planning Act, R.S.O. 1970, chapter 349 and amendments thereto, or successor thereof. -z- 3. This Agreement shall enure to the benefit of and be binding upon the Parties hereto, their succes- sors and assigns. IN WITNESS WHEREOF, the Parties hereto have hereunto affixed their corporate seals, as attested to by their proper signing officers duly authorized in that regard. CHIAVATTI DEVELOPMENTS LIMITED President REMO CHIAVATTI LIMITED President SILVIO CHIAVATTI LIMITED President THE CORPORATION OF THE TOWN OF PICKERING Mayor SCHEDULE "A" ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the Town of Pickering, in the Regional Municipality of Durham (formerly in the Township of Pickering, in the County of Ontario) being the whole of Lot 70 and the southerly 100 feet of Lot 69, according to a Plan registered in the Land Registry Office for the Registry Division of Durham as Number 350. SAVING AND EXCEPTING THEREFROM that part of said Lot 70, being shown as Parts 1, 2 and 3 on a Description Reference Plan of Survey deposited in the said Land Registry Office as Number 40R-5022.
