BY-LAW NO. 1178/80
Being a By-Law to authorize the execution
of a release and discharge of the Subdi-
vision Agreement dated June 20th, 1977
between Alves Construction Limited and
the Corporation of the Town of Pickering
respecting the subdivision and develop-
ment of Plan M-1122.
WHEREAS, the Corporation of the Town of Pickering
and Alves Construction Limited entered into a Subdivision
Agreement on June 20th, 1977, respecting the subdivision
and development of Registered Plan of Subdivision M-1122,
Pickering; and
WHEREAS, Alves Construction Limited, and its suc-
cessors have complied with all of their obligations and
covenants pursuant to the said Agreement, to the satisfac-
tion of the Town;
NOW THEREFORE, the Council of the Corporation of
the Town of Pickering HEREBY ENACTS AS FOLLO',9S:
1. The Mayor and Clerk are hereby authorized to
execute a release and discharge, in the form
attached hereto as Schedule "A", of the Sub-
division Agreement dated June 20th, 1977
between Alves Construction Limited and the
Corporation of the Town of Pickering,
respecting the subdivision and development
of Plan of Subdivision M-1122.
BY-LAW read a first, second and third time and finally passed
this 6th day of October , 1980.

SCHEDULE "A" to By-law 1178/80
RELEASE AND DISCHARGE
WHEREAS, by Agreement dated June 20th, 1977, Notice
of which was registered on October 5th, 1977 in the Land
Titles Office for the Registry Division of Durham as Instru-
ment No. LTD53692, between,
ALVES CONSTRUCTION LIMITED
hereinafter referred to as the "Company"
- and -
CORPORATION OF THE TOWN OF PICKERING
hereinafter referred to as the "Town"
the Company made certain covenants and agreements with the
Town relating to the subdivision and development of certain
lands described in Schedule "A" hereto; and
WHEREAS, the Company has complied with all of its obli-
gations and covenants pursuant to the said Agreement to the
satisfaction of the Town;
NOW THEREFORE, this Release and Discharge witnesseth
that the Town hereby certifies that the Company has complied
with all of its obligations and covenants of every kind aris-
ing from the terms and provisions of the said Agreement, and
THE TOWN HEREBY remises, releases and forever dis-
charges the Company, its successors and assigns, from any
and all liabilities, actions, causes of action, debts,
claims or demands of any kind whatsoever which the Company
may have been, is, or may become subject to pursuant to the
provisions of the said Agreement.
THIS RELEASE AND DISCHARGE affects the lands and
premises more particularly described in Schedule "A" attached
hereto.
IN WITNESS WHEREOF, the Town has hereunto affixed its
Corporate Seal attested to by its properly authorized officers.

SCHEDULE "A"
ALL AND SINGULAR those certain parcels or tracts of lands and
premises situate, lying and being in the Town of Pickering,
in the Regional Municipality of Durham and Province of Ontario
and being composed of Lots 1, 2, 3 and 4 and Block A, all
according to a Plan registered in the Land Titles Office for
the Registry Division of Durham as Plan M-1122.
