BY-LAW NUMBER 1165/80
Being a by-law pursuant to The Line
Fences Act, 1979, to provide that the
Town Treasurer may pay to an entitled
owner an amount certified, or a por-
tion thereof.
WHEREAS pursuant to subsection 6 of section 12 of The Line
Fences Act, 1979, s.o. 1979, chapter 31, the council of a
local municipality may provide that where a certificate and
an award are deposited with the clerk of the municipality,
the treasurer of the municipality may, upon written appli-
cation therefore, pay to the owner entitled to receive the
amount certified, the amount so certified or a portion
thereof, where the treasurer is satisfied that the owner
is entitled thereto; and
WHEREAS it is deemed expedient to enact such a by-law to
pay entitled owners accordingly;
NOW THEREFORE the Council of the Corporation of the Town
of Pickering HEREBY ENACTS as follows:
1. Where a certificate prepared under the provisions
of subsection 1 of section 12 of The Line Fences
Act, 1979, s.o. 1979, chapter 31, and an award in
respect of which the certificate was made have been
made in respect of lands situate within the boun-
daries of the Town of Pickering, such certificate
and award, or copies thereof certified by a clerk
in accordance with the said Act, may be deposited
with the Clerk of the Town of Pickering, and the
Treasurer of the Town of Pickering may, upon written
application therefore, pay to the owner entitled to
receive same, the amount so certified, or a portion
thereof, where the Treasurer is satisfied that the
owner is entitled thereto.
