HomeMy WebLinkAboutBy-law 1158/80THE CORPORATION OF THE TOWN.OF PICKERING BY-LAW NUMBER 1158/80 Being a Restricted Area By-law to amend Restricted Area By-law 3036, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, in Part �ot 23, • Concession 2, in the Town of Pickering. WHEREAS the Council of the Corporation of the Town of Pickering deems it desirable to permit the development of a commercial building on the subject lands; AND WHEREAS an amendment to By-law 3036, as amended, is therefore deemed necessary; NOW THEREFORE THE CORPORATION OF THE COUNCIL OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. AREA RESTRICTED The provisions of this By-law shall apply to those lands in Lot 23, Concession 2, Pickering, designated "C4" on Schedule "I" attached hereto. GENERAL PROVISIONS No building, land be used, occupied, altered except in of this By-law. (2) "Dry Cleaning Depot" shall mean a building or part of a building used for the purpose of receiving articles, goods or fabrics to be subjected to dry cleaning and related processes elsewhere, and of distributing articles, 9oods or fabrics which have been subjected to any such processes. _'Y _:�.;,`.��,; continued... Page 2 (3) (a) "Floor Area" shall mean the area of the floor surFace contained within the outside walls of a storey or part of a storey. (b) "Gross Floor Area" sha11 mean the aggregate of the floor areas of all the storeys of a building or structure, or a part thereof as the case may be, other than a private garage, an attic or a cellar. (4) "Laundromat" shall mean a self-serve clothes washing establishment containin9 one or more washers and drying, ironing, finishing or other incidential equipment. (5) "Lot Coverage" shall mean the percentage of lot area covered by all buildings on the lot. (6} "Lot Frontage" shall mean the width of a lot between the side lot lines measured along a line parallel to and 7.5 metres distant from the front lot line. (7) "Neighbourhood Store" shall mean a store in which food, drugs, periodicals or similar items of day- to-day household necessity are kept for retail sale primarily to residents of, or persons employed in the immediate neighbourhood. (8) "Personal Service Shop" shall mean an establishment where a personal service is performed and may include a barber shop, a beauty salon, a shoe repair shop, a tailor or dressmaking shop or a photographic studio, but shall not include a bodyrub parlour as defined in The Municipal Act, R.S.O. 1970, Chapter 284, or any successor thereto. (9) "Professional Office" shall mean a building or part of a building in which medical, legal or other professional service is performed or consultation given and may include a clinic and the offices of an architect, chartered accountant, engineer, lawyer or physician but shall not include a bodyrub parlour as defined in The Municipal Act, R.S.O. 1970, Chapter 284, or any successor thereto. (10) (a) "Yard" shall mean an area of land which is appurtenant to and located on the same lot as a building or structure and is open, uncovered andunoccupied above ground except for such accessory buildings, structures, or other uses as are specifically permitted thereon. (b) "Front Yard" shall mean a yard extending across the f-- ull width of a lot between the front lot line of the lot and the nearest wall of the nearest main buildin9 or structure on the lot. (c) "Front Yard Depth" shall mean the shortest horizontal dimension of a front yard of a lot between the front lot line and the nearest wall of the nearest main building or structure on the iot. continued... Page 3 {d) "Rear Yard" shall mean a yard extending across fhe full width of a lot between the rear lot line of the lot or, where there is no rear lot line, the junction point of the side lot lines, and the nearest wall of the nearest main building or structure on the lot. (e) "Rear Yard Depth„ shall mean the shortest horizonta dimension of a rear yard of a lot between the rear lot line or, where there is no rear lot line, the junction point of the side lot lines, and the nearest wall of the nearest main building or structure on the lot. (f) "Side Yard" shall mean a yard of a lot extending from the front yard to the rear yard and from the side lot line to the nearest wall of the nearest main building or structure on the lot. (g) "Side Yard Width" shall mean the shortest horizontal dimension of a side yard of a lot between the side lot line and the nearest wall of the nearest main building or structure on the lot. (h) "Fiankage Side Yard" sha11 mean a side yard immediately adjoining a street or abutting on a reserve on the opposite side of which is a street. (i) "Interior Side Yard" shall mean a side yard other than a flankage side yard. 5. PROVISIONS (1) Uses Permitted ("C4" Zone) No person shall within the lands designated "C4" on Schedule "I" hereto use any lot or erect, alter or use any building or structure for any purpose except the following: {a) business offices (b) dry cleaning depots (c) laundromats (d) neighbourhood stores (e) personal service shops (f) professional offices (2) Zone Requirements (G4" Zone) (a) For the purpose of this subsection the lot line flanking Bushmill Street or an abutting reserve shall be deemed to be the front lot line (b) No person shall within the lands designated "C4" on Schedule "I" hereto use any lot or erect, alter or use any building or structure except in accordance with the following provisians: (i) LOT AREA (minimum): 0.4 hectares continued (ii) LOT FRONTAGE (minimum): (iii) FRONT YARD DEPTH (minimum) Page 4 45 metres 12 metres (iv) INTERIOR SIDE YARD WIDTH (minimum): 4.5 metres, except where an interior side lot line abuts a residential zone, the minimum interior side yard width shall be 7.5 metres (v) FLANKAGE SIDE YARD WIDTH (minimum): (vi) REAR YARD WIDTH (minimum) (vii) LOT COVERAGE (maximum): (viii) BUILDING HEIGHT (maximum) (ix) PARKING REQUIREMENTS {minimum): (x) SPECIAL RESTRICTIONS: 6. BY-LAW 3036 12 metres 7.5 metres 33 percent 12 metres 4.5 parking spaces per 93 square metres gross floor area 1. The gross floor area ofi all buildings on the lot shall not exceed 929 square metres By-law 3036, as amended, is hereby further amended only to the extent necessary to give effect to the provisions of this By-law as it applies to the area set out in Schedule "I" attached hereto. Definitions and subject matters not specifically dealt with in this By-law shall be governed by the relevant provisions of By-law 3036, as amended. 7. ENFORCEMENT Any person who contravenes any of the provisons of this By-law shall be liable upon conviction thereof to a fine not exceeding $1,000.00 for each offence, exclusive of costs, recoverable under The Provincial Offences Act, 1979. 8. EFFECTIVE DATE This Sy-law sfiall take effect from the day of passing hereof subject to the approval of the Ontario Municipal Board, if required.
