HomeMy WebLinkAboutBy-law 1089/80THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 1089/80 Being a By-Law to authorize the execution of a Release and Discharge of the Subdivi- sion Agreement dated June 18th, 1973, between Pickering Development Company and the Corporation of the Township of Pickering, respecting the subdivision and development of Plans M-997 and M-998. WHEREAS, the Corporation of the Township of Pickering and Pickering Development Company entered into a Subdivision Agreement on June 18th, 1973, respecting the subdivision and development of Registered Plans of Subdivision M-997 and M-998, Pickering; and WHEREAS, the Corporation of the Town of Pickering is the successor to the corporation of the Township of Pickering; and WHEREAS, Pickering Development Company has complied with all of its obligations and covenants pursuant to the said Agreement, to the satisfaction of the Town; NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release and Discharge, in the form attached hereto as Schedule "A" of the Sub- division Agreement dated June 18th, 1973, between Pickering Development Company and the Corporation of the Township of Pickering, respecting the subdivision and development of Plans of Subdivision M-997 and M-998. BY-LAW read a first, second and third time and finally passed this 4th day of February , 1980. IIC u:i'r'tL .t Mayor SCHEDULE "A„ By-law 1089/80 RELEASE AND DISCHARGE WHEREAS, by Agreement dated June 18th, 1973 and registered on March 8th, 1974 in the Land Titles Office for the Registry Division of Durham as Instrument No. 44532 (Plan M-997) and Instrument No. 44538 (Plan M-998) between, J.D.S. INVESTMENTS LIMITED NORTH KEELE INVESTMENTS LIMITED WALBI HOLDING COMPANY LIMITED JANBI HOLDING COMPANY LIMITED PINETREE DEVELOPMENT CO. LIMITED BRIDGEVIEW HEIGHTS LIMITED and TAMAY REALTY LIMITED carrying on business as PICKERING DEVELOPMENT COMPANY hereinafter referred to as the "Company" - and - THE CORPORATION OF THE TOWNSHIP OF PICKERIN hereinafter referred to as the "Township" the Company made certain covenants and agreements with the Town- ship relating to the subdivision and development of certain lands described in Schedule "A" hereto; and WHEREAS, pursuant to the provisions of The Regional Municipality of Durham Act, 1973, S.O. 1973, c.78, THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town" is the successor to the Township; and WHEREAS, the Company has complied with all of its obligations and covenants pursuant to the said Agreement to the satisfaction of the Town; NOW THEREFORE, this Release and Discharge witnesseth that the Town hereby certifies that the Company has complied with all of its obligations and covenants of every kind arising from the terms and provisions of the said Agreement, and The Town hereby remises, releases and forever discharges the Company, its successors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of the said Agreement. This Release and Discharge affects the lands and premises more particularly described in Schedule "A" attached hereto. IN WITNESS WHEREOF, the Town has hereunto affixed its Corporate Seal duly attested to by its properly authorized officers. DATED at Pickering this day of 1980.
