HomeMy WebLinkAboutBy-law 1392/81THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 1392 /81 Being a By-Law to authorize the execution of a Release by the Corporation of the Town of Pickering of Michael Broz and Mira Penic from a Development Agreement respec- ting Lot 71, Plan 350, Pickering (LD 136/77) WHEREAS the Corporation of the Town of Pickering and Michael Broz and Mira Penic entered into an Agreement dated September 13th, 1977 and registered September 14th, 1977 as Instrument No. D55070; and WHEREAS it is now deemed expedient to release Michael Broz and Mira Penic from the provisions of the said Agreement; NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release, in the form attached hereto as Schedule "A", of a Development Agree- ment dated September 13th, 1977, between Michael Broz and Mira Penic respecting Part Lot 71, Plan 350, Pickering. (LD 136/77) READ a first, second and third time and finally passed this 2nd day of November 1981. C?7-erk ?? R E L E A S E In consideration of the sum of Two Dollars ($2.00) paid to it, receipt of which is hereby by it acknowledged, THE CORPORATION OF THE TOWN OF PICKERING hereby releases and forever discharges MICHAEL BROZ and MIRA PENIC their heirs, executors, administrators, successors and assigns of and from all claims, demands, damages, actions or causes of action which may have arisen, are arising, or may arise as a result of or in any way related to an Agreement dated September 13th, 1977 and registered as Instrument No. D55070 between THE CORPORATION OF THE TOWN OF PICKERING and MICHAEL BROZ and MIRA PENIC concerning the lands more particularly described in Schedule "A" attached hereto. IN WITNESS WHEREOF the Corporation of the Town of pickering has hereunto affixed its corporate seal attested by its properly authorized officers this day of , 1981. SIGNED, SEALED & DELIVERED Mayor e SCHEDULE "A" ALL AND SINGULAR that certain parcel or tract of land and premises sit- uate, lying and being in the Town of Pickering, in the Regional munici- pality of Durham and Province of Ontario and being composed of all of Lot 71, according to a plan registered in the Registry Office for the Registry Division of Durham as Plan 350, SAVE AND EXCEPT that part of Lot 71 designated as Part 1 on a Plan of Survey of record registered in the said office as Number 40R-37541 AS DESCRIBED in Instrument No. D55070. THIS AGREEMENT made in duplicate this rjo day of X? B E T W E E N: THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town" OF THE FIRST PART - and - MICHAEL BROZ, and MIRA PENIC hereinafter referred to as the "Owner" OF THE SECOND PART WHEREAS the Owner is the owner in fee simple of certain lands and premises more particularly described in Schedule "A" hereto; AND WHEREAS the Owner wishes to deal with those lands and premises in a certain manner; AND WHEREAS the Owner is therefore required by Decision, dated the 2nd day of May, 1977, of the Land Division Committee of the Regional Municipality. of Durham to enter into a certain agreement or agreements with the Town; NOW THEREFORE THIS AGREEMENT WITNESSETH THAT, in consideration of mutual benefits, the Parties hereto agree as follows: 1. The lands and premises affected by this agreement are those lands and premises more particularly described in Schedule "A" hereto. 2. The Owner agrees that the lands and premises affected by this agreement shall only be developed by plan of subdivision, approved by the Province of Ontario and the Town, and further that the existing dwelling thereon shall be removed therefrom at the time such development takes place and that such removal shall be a condition of the approval of the "subdivision by the Town. 3. This agreement and everything contained herein shall enure to the benefit of and be binding upon the Parties hereto and their successors and assigns. IN WITNESS WHEREOF the Party of the First Part has hereto affixed its corporate seal attested by the hands of its duly authorized officers and the persons comprising the Party of the Second Part have hereto affixed their hands and seals.
