HomeMy WebLinkAboutBy-law 1367/81THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 1367/81 Being a Restricted Area By-Law to amend Restricted Area By-Law 3037, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, on Part of Lot 33, Concession 6, in the Town of Pickering. WHEREAS the Council of the Corporation of the Town of Pickering deems it desirable to amend By-Law 3037, as amended, to permit general con- tracting and outside storage in association therewith on the subject lands being part of Lot 33, Concession 6; and WHEREAS an amendment to By-Law 3037, as amended, is therefore deemed necessary; NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. TEXT AMENDMENT Section 7 of By-Law 3037, as amended, is hereby further amended by adding thereto the following subsection: 7.5 EXCEPTIONS 7.5.1 Part Lot 33, Concession 6 (a) In this paragraph the term, 1. "general contracting" shall mean the carrying on and operation of a contractor's yard, in- cluding the servicing and repairing of vehicles and equipment, the storage of new and used material, vehicles and equipment but not including a cement batching plant, asphalt plant, pit or quarry or uses ancil- liary thereto. (b) In addition to the provisions of section 7.1 hereof, the lands designated "V-1" on Schedule I to this By-Law may be used, 1. for the purpose of general contracting, pro- vided that, with the exception of otherwise permitted outside storage associated there- with, such use shall be permitted only when carried on within enclosed buildings; and 2. for the purpose of outside storage in associ- ation with general contracting, provided that, (i) such storage is limited to the side and rear yards only, and (ii) such storage is limited to the storage of building material, sand, gravel and top soil only. - 2 - 2. SCHEDULE AMENDMENT Schedule "A" to By-Law 3037, as amended, is hereby further amended by altering from "V" to "V-1" the zone designation of the lands designated "V-1" on Schedule "I" hereto. 3. EFFECTIVE DATE This By-Law shall take effect from the day of passing hereof, sub- ject to the approval of the Ontario Municipal Board, if required.
