HomeMy WebLinkAboutBy-law 1352/81THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO.1352 /81 Being a By-Law to authorize the execution of a Release by the Corporation of the Town of Pickering of Joseph and Ingrid Verbancic from a Demolition Agreement respecting Part Lot 32 and part of the road allowance between Lots 32 and 33, Concession 1, Pickering WHEREAS the Corporation of the Town of Pickering and Joseph Verbancic and Ingrid Verbancic entered into an Agreement dated July 11th, 1977 and registered August 22nd, 1977 as Instrument No. D53547; and WHEREAS it is now deemed expedient to release Joseph Verbancic and Ingrid Verbancic from the provisions of the said Agreement; NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release, in the form attached hereto as Schedule "A", between Joseph Verbancic and Ingrid Verbancic respecting Part Lot 32 and part of the road allowance between Lots 32 and 33, Concession 1, Pickering. BY-LAW read a first, second and third time and finally passed this 8th day of September, 1981. Clerk TOWN 0 AD 'f L E A S E In consideration of the sum of Two Dollars ($2.00) paid to it, receipt of which is hereby by it acknowledged, THE CORPORATION OF THE TOWN OF PICKERING hereby releases and forever discharges JOSEPH VERBANCIC and INGRID VERBANCIC their heirs, executors, administrators, successors and assigns of and from all claims, demands, damages, actions or causes of action which may have arisen, are arising, or may arise as a result of or in any way related to an Agreement dated July 11th, 1977 and registered as Instrument No. D53547 between THE CORPORATION OF THE TOWN OF PICKERING and JOSEPH VERBANCIC and INGRID VERBANCIC concerning the lands more particularly described in Schedule "A" attached hereto. IN WITNESS WHEREOF the Corporation of the Town of Pickering has hereunto affixed its corporate seal attested by its properly authorized officers this 21st day of September, 1981. SIGNED, SEALED & DELIVERED THE CORPORATION OF THE TOWN OF PICKERING Mayor C SCHEDULE "A" ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the Town of Pickering, in the Regional Municipality of Durham and Province of Ontario, being part of Lot 32, in Concession 1 of the said Town and part of the original road allowance between said Lot 32 and Lot 33 in said Concession, more particularly described as follows: COMMENCING at a point in the easterly limit of the existing road allowance between said Lots 32 and 33 at a point dis- tant 1,476 feet 1-1/2 inches measured southerly along said easterly limit from its intersection with the westerly production of the northern boundary of said Lot 32, being 46 feet 2-1/2 inches west from the north-west angle of Lot 32; THENCE NORTHERLY along the said east limit of said road allowance, a distance of seventy-seven feet ten and one-half inches (77 feet 10-1/2 inches) more or less to an iron bar planted in the said east limit marking the southerly limit of lands heretofore conveyed to the Hydro Electric Power Commission of Ontario by Florence E. Schwalm of the Town of Pickering in the Regional Municipality of Durham; THENCE NORTHERLY forty-eight degrees seven minutes East (N48 7'E) along the said southerly boundary of the lands heretofore conveyed to the Hydro Electric Power Commission of Ontario a distance of seven hundred and eighty feet nine inches (780 feet 9 inches) more or less to a point in the fence marking the boundary between the east and west halves of said Lot; THENCE Southerly along the said boundary between the east and west halves of said Lot, a distance of Two hundred and fifty-five feet eight and one-half inches (255' 8-1/2 inches) more or less to a point in the said boundary which said point is distant Twelve hundred and ninety-eight feet three and one-half inches (1,298 feet 3-1/2 inches) measured southerly along the said boundary from its intersection with the northerly limit of the said Lot; THENCE Westerly in a straight line Seven hundred and twenty feet (720 feet) more or less to the Place of Beginning. SAVE AND EXCEPT that part of the said lands expropriated by the Corporation of the County of Ontario (now the Regional Municipality of Durham) shown on Plan 23, AS DESCRIBED in Instrument No. D53547.
