BY-LAW NUMBER 1601/82
Being a Restricted Area By-law to amend
Restricted Area By-law 3036, as amended
to implement the Official Plan of the
Town of Pickering District Planning Area,
Region of Durham in Part of Lot 18,
Concession l, in the Town of Pickering.
WHEREAS the Council of the Corporation of the Town of
Pickering deems it desirable to recognize as legal the
existing situation on the subject lands;
AND WHEREAS an amendment to By-law 3036, as amended, is
therefore deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
SECTION 12 - GENERAL COMMERCIAL ZONE of By-law 3036 as
amended, is hereby further amended by adding thereto
the following subsection:
12.4.3 PART LOT 18, CONCESSION 1
(1)
For the purpose of this subsection the term
'Automobile Service Station Type A' shall
mean an establishment where only vehicle fuels,
lubricants and accessories are offered for retail
sale.
(2)
Notwithstanding any of the provisions of this
By-law, in addition to any other uses that may
be permitted thereon, the lands zoned 'C2' on
Schedule 'I' to By-law 1601/82 may be used for
the purpose of an Automobile Service Station -
Type A.
(3)
Notwithstanding the provisions of Sections 5.18
and 12.2.2 of this By-law a Kiosk which is
accessory to an Automobile Service Station
Type A located on the lands zoned 'C2' on
Schedule "I" to By-law 1601/82 may be located
in the front yard provided it is set back a
minimum of 9 metres from every lot line.
2. EFFECTIVE DATE
This By-law shall take effect from the day of passing
hereof, subject to the approval of the Ontario Municipal
Board, if required.
