BY-LAW NUMBER 157~/82
Being a Restricted Area By-law to amend
By-law 1200/80, amending Restricted
Area By-law 2511, as amended, to implement
the Official Plan of the Town of Pickering
District Planning Area, Region of Durham
on Blocks E & F, Plan 239 and Part of St.
Martin's Drive (Part 1, Plan 40R-590), in
the Town of Pickering.
WHEREAS the Council of the Corporation of the Town of Pickering
passed By-law 1200/80, amending By-law 2511, to permit the
establishment of a senior citizen's apartment dwelling, in
addition to the existing church, on the subject lands being
Blocks E and F, Plan 239, and part of St. Martin's Drive
Part 1, Plan 40R-590) Town of Pickering;
AND WHEREAS the Council of the Corporation of the Town of
Pickering now deems it desirable to amend By-law 1200/80
to permit the establishment of a day nursery in the existing
church building.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. BY-LAW 1200/80
By-law 1200/80 which was passed by the Council Of the Corporation
of the Town of Pickering on the 24th day of November 1980, and
which came into force on December 17th, 1980, is hereby amended
only to the extent necessary to give effect to the provisions
of this By-law.
2. TEXT AMENDMENT
(1) Section 4 of By-law 1200/80 is hereby amended by adding
thereto the following definition:
d)
"Da2 Nurser~_-Type ~[ shall mean lands and premises
duly licenced pursuant to the Day Nurseries Act,
or any successor thereto, for use as a facility
for the daytime care of not more than sixty-five
(65) children at any one time.
(2) Section 5.1.A of By-law 1200/80 is hereby amended by
adding thereto the followin.9 permitted use:
c) day nursery-type B
(3) Section 5.1.B of By-law 1200/80 is hereby amended
by adding thereto the following zone requirement:
h) SPECIAL RESTRICTIONS
1. A day nursery-type B may be permitted
only in a church building on the site.

3. SCHEDULE AMENDMENT
Schedules "I" and "II" to By-law 1200/80 are hereby amended
by altering from "I(C) R(SC)" to "I(C)(DN) - R(SC)" the
zone designation of the lands designated "I(C) R(SC)"
on Schedule "I" and "II" of By-law 1200/80.
4. EFFECTIVE DATE
This By-law shall take effect from the day of passing hereof,
subject to the approval of the Ontario Municipal Board, if
required.

subject lands to permit the operation of a day nursery
facility in the existing church building.
