HomeMy WebLinkAboutBy-law 1477/82THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 1477/82 Being a By-Law to amend By-Law 3821/70 regulating and prohibiting certain noise WHEREAS, pursuant to the provisions of a pedecessor of section 210.132 of the Municipal Act, R.S.O. 1980, chapter 302, the Council of the Corporation of the Township of Pickering, on June 1st, 1970, enacted By-Law 3821/70 regulating and prohibiting certain noise; and WHEREAS, the Corporation of the Town of Pickering is the successor to the Corporation of the Township of Pickering; NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: Section 6 of By-Law 3821/70, as amended by By-Laws 497/76 and 723/77, is hereby revoked and the following substituted therefor: 6. (1) The provisions of this By-Law shall not apply to: (a) any ringing of church or school bells; (b) any case of public convenience or necessity; (c) any parade or public gathering operating for a limited period of time under permit of the Town and the Chief of the Durham Regional Police Force; (d) any signals authorized or required by compe- tent legislation; (e) any noise originating from, or caused by, the operation or use by any person, includ- ing the Town, of any community centre or public park owned by or under lease to the Town, whether or not the Town has issued a permit for such operation or use; <f) any noise originating from, or caused by, the operation of farm equipment or machinery for cultivating, seeding, crop maintenance or harvesting purposes on any lands designa- ted for agricultural uses in Concessions 2, 3, 4, 5, 6, 7, 8 and 9; and (g) any declared emergency. (2) ~lo situation shall be dec!are~ an emergency for the purposes of clause (g) of subsection (1) hereof, un- less so declared by Resolution of the Council of the Corporation of the Town of Pickering, at its sole discretion. (3) Any declaration made pursuant to subsection (2) hereof may be retrospective in effect. - 2 - Section 7 of By-Law 3821/70, as amended by By-Law 662/77, is hereby revoked ~nd the following substituted therefor: Every person who contravenes any provision of this By-Law shall be guilty of an offence, and upon conviction shall be liable to a fine of not more than Two Thousand Dollars for each offence, exclusive of costs, recoverable under the provisions of the Provincial Offences Act, R.S.O. 1980, c. 400, as amended from time to time. The provisions by this By-Law, Municipal Code of sections 6 and 7 of By-Law 3821/70, as remade shall be incorporated in The Town of Pickering as sections 6150.6.1 and 9540.1, respectively. BY-LAW read a first, second and third time and finally passed this Third day of May , 1982.
