BY-LAW NUMBER 1469/82
Being a Restricted Area By-law to amend Restricted
Area By-law 3037, as amended, to implement the
Official Plan of the Town of Pickering District
Planning Area, Region of Durham, on Part Lot 18,
Concession 3, in the Town of Pickering.
WHEREAS the Council of the Corporation of the Town of Pickering
deems it desirable to allow the development of an automobile
service station on the subject lands being part of Lot 18,
Concession 3.
AND WHEREAS an amendment to By-law 3037, as amended, is
therefore deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLO~tS:
1. TEXT AMENDMENT
Section 6.1.5 of By-law 3037, as amended, is hereby
further amended by adding thereto the following
subsection:
6.1.5.9 Part Lot 18, Concession 3
(1) Definitions
For the purposes of this subsection:
(i
"Automobile Service Station Type C" shall
mean an establishment where vehicle fuels,
lubricants and accessories are offered for
retail sale and where facilities for the
repair and maintenance of vehicles may be
provided on the premises and may include a
car wash but shall not include a body shop,
as defined herein.
(ii
"Bgdy Shop" shall mean an establishment primarily
engaged in repairing or painting vehicle bodies.
(iii
"Car Wash" shall mean a building or structure
c~ntaining' facilities specifically used or
intended to be used for washing vehicles either
by production line methods employing mechanical
devices or by hand.
(2)
Notwithstanding the provisions of Section 6.1 of this
By-law, the lands designated "CA" on Schedule "I" to
By-law may be used for the purpose of an
Automobile Service Station-Type C in accordance with
the provisions of Section 5.17 (a), (b), (c) and (d).
2. EFFECTIVE DATE
This By-law shall take effect from the day of passing
hereof, subject to the approval of the Ontario Municipal
Board, if required.
