HomeMy WebLinkAboutBy-law 1429/82THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 1429/82 Being a By-Law to authorize the execution of an Agreement between J. F. Coughlan Construction Co. Limited and the Corporation of the Town of Pickering respecting the future development of Part Lot 33, Range 3, B.F.C., Pickering (LD 275/81) WHEREAS, by decision dated July 27th, 1981, the Regional Municipality of Durham Land Division Committee approved the severance of part of Lot 33, Range 3, Broken Front Concession, Pickering subject to several conditions, one of which requires than an Agreement be entered into respecting the future development of the lands herein; NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: The Mayor and Clerk are hereby authorized to execute an Agreement, in the form attached hereto as Schedule "A", between J. F. Coughlan Construction Co. Limited and the Corporation of the Town of Pick- ering respecting the future development of Part Lot 33, Range 3, B.F.C., Pickering (LD 275/81) BY-LAW read a first, second and third time and finally passed this 1st day of February , 1982. Schedule "A" to By-law 1429/82 THIS AGREEMENT made in triplicate this lst day of Pebruary, 1982. BETWEEN : THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town" OF THE FIRST PART, - and - J. F. COUGHLAN CONSTRUCTION CO. LIMITED hereinafter referred to as the "Owner" OF THE SECOND PART. WHEREAS the Owner is the owner in fee simple of certain lands and prem- ises more particularly described in Schedule "A" hereto, which Schedule is a part of this Agreement; and WHEREAS the Owner wishes to deal with those lands and premises in a certain manner; and WHEREAS the Owner is therefore required by Decision, dated the 27th day of July, 1981, of the Land Division Committee of the Regional Munici- pality of Durham to restrict the future development of the lands affected hereby to development by plan of subdivision only; NOW THEREFORE, THIS AGREEMENT WITNESSETH THAT, in consideration of mutual benefits, the Parties hereto agree as follows: The lands and premises affected by this Agreement (the "subject lands") are those lands and premises more particularly described in Schedule "A" hereto, which Schedule is hereby made a part of this Agreement. No application shall be made by the Owner or any person on its behalf to the Town or to the said Land Division Committee or to any other governmental body in that regard, for severance of any part of the subject lands from any other part thereof except by plan of subdivision only. This Agreement shall run with the land and it, and everything herein contained, shall enure to the benefit of and be binding upon the Parties hereto, their successors and assigns. IN WITNESS WHEREOF the Parties hereto have hereun%o affixed their respective Corporate Seals, duly attested by the hands of their proper authorized officers. LIMITED Per: Per: SCHEDULE "A" ALL AND SINGULAR that certain parcel or tract of land and premises lying, situate and being in the Town of Picketing, in the Regional Municipality of Durham and Province of Ontario and being composed of that part of Lot 33, Range 3, Broken Front Concession, designated as Parts 2 and 3, on a Plan of Survey of record deposited in the Land Titles Office for the Registry Division of Durham (No. 40) as Plan 40R- 6677. 0 ~0 H 6~
