HomeMy WebLinkAbout By-law 1755/83THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 1755/83 Being a by-law to amend By-law Number 851/78 to authorize certain on-street parking of vehicles operated by or for physically handicapped persons and the issuing of permits in respect thereof WHEREAS Council enacted By-law 851/78 on July 10, 1978 to provide for the regulating of parking, standing and stopping on highways or parts of highways under the jurisdiction of the Corporation of the Town of Pickering and on private and municipal property; and WHEREAS by By-law 1296/81 enacted on July 1, 1981, By-law 851/78 was amended to provide for exemptions for physically handicapped persons' vehicles and parking spaces for physi- cally handicapped persons' vehicles; and WHEREAS by Resolution ~26/83, Item 46 passed on March 21, 1983, Council agreed to participate in a Regional Handicapped Parking Program; NOW THEREFORE the Council of the Corporation of the Town of Pickering HEREBY ENACTS as follows: Section 10a of By-law 851/78 is hereby deleted and the following substituted therefor: 10a. (1) In this section, and in section 10b, (a) "permit" shall mean a permit issued on an annual basis to a physically handicapped person by the Town of Pickering; (b) "physically handicapped person" shall mean a person who is permanently confined to a wheelchair or who is restricted to the permanent use of crutches or braces or who otherwise is permanently disabled in such a way that his or her mobility is seriously restricted. (2 The Town Clerk is hereby authorized to issue permits to physically handicapped persons to allow on-street parking of vehicles operated by or for physically handicapped persons. (3 The Town Clerk is hereby authorized to issue an identifying marker to be used in connection with a permit issued pur- suant to subsection 2 of this section. (4 No person other than a physically handi- capped person shall acquire or use a permit allowing parking of vehicles operated by or for physically handicapped persons. e 10a. (5) (6) (7) (8) (9) Paragraph 851/78 is therefor: No person, other than a physically handicapped person who has lawfully acquired a permit pursuant to subsection 2 of this section shall acquire or use an identifying marker issued in connection with a permit. No person shall use, other than in the manner provided for in this by-law, an identifying marker issued in connection with a permit. (a) (b) The identifying marker issued in connection with a permit shall be affixed to the sun visor of the driver or passenger's side of the motor vehicle operated by or for a physically person and such identifying marker shall be affixed in such a manner so that it is readily visible from outside of the vehicle when the visor is turned down; An identifying marker issued in connection with a permit shall be deemed to be pro- perly displayed when the visor is turned down and the identifying marker is readily visible from the outside of the vehicle. A permit or other marker issued by the ~{uni- cipality of Metropolitan Toronto for the purpose of identifying handicapped persons or vehicles used by handicapped persons shall be deemed to be permits issued under the authority of this by-law. Nothwithstanding the provisions of any section of By-law 851/78, as amended, and notwith- standing the display of authorized signs to the contrary, where a vehicle operated by or for a physically handicapped person in respect of which person a permit has been issued and on which vehicle the identifying marker issued in connection with said permit is properly displayed, the owner and the driver of such vehicle is exempt from the following provision of the by-law: (a) Section 3(5) (j), provided that no such vehicles shall be parked on any highway pursuant to this section for a period exceeding 24 hours. (a) of subsection 4 of section 10b of By-law hereby deleted and the following substituted 10b. (4) (a) (i) (2) "the vehicle is a vehicle in respect of which ~ permit is in effect and on which an identifying marker is properly dis- played, and" Paragraph (d) of subsection (1) of section 11 of By-law 851/78 is hereby amended by deleting there- from the words "or of subsection (4) of section 10b" Subsection (1) 9f section 11 of By-law 851/78 is hereby amended by adding thereto the following paragraph: 3. (2) "(e) (3) (1) Fifty Dollars ($50.00) for each offence, exclusive of costs where the contraven- tion is of the provisions of subsection (4) of section 10b of this by-law;" Paragraph (e) of subsection (1) of section 11 of By-law 851/78 is hereby renumbered to paragraph (f). Paragraph (d) of subsection (2) of section 11 of By-law 851/78 is hereby amended by deleting there- from the words "or of subsection (4) of section 10b." (2) Subsection (2) of section 11 of By-law 851/78 is hereby amended by adding thereto the following: "(e) Fifty Dollars ($50.00) for each offence, exclusive of costs where the contraven- tion is of the provisions of subsection (4) of section 10b of this by-law;" BY-LAW READ a first, second and third time and finally PASSED this 21st day of November, 1983. clerk
