BY-LAW NUMBER 1735/83
Being a Restricted Area By-law to amend
Restricted Area By-law 3036, as amended,
to implement the Official Plan of the
Town of Pickering District Planning Area,
Region of Durham on Part Block 14, Plan
40M-1231 in the Town of Pickering.
WHEREAS the Council of the Corporation of the Town of Picketing passed
By-law 1346/81, amending By-law 3036 to permit the establishment of
residential apartment dwelling units on the subject lands being Part
Block 14, Plan 40M-1231 Town of Pickering:
AND WHEREAS the Council
now deems it desirable
establishment of a day
of the Corporation of the Town of Pickering
to further amend By-law 1346/81 to permit the
nursery in addition to presently permitted uses;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING
HEREBY ENACTS AS FOLLOWS:
1. SCHEDULE AMENDMENT
Schedule "I" to By-law 1346/81 is hereby amended by hatching
that portion of the lands, designated "RMII" thereon, comprising
that part of Block 14, Plan 40M-1231, designated as Part l,
Plan 40R-6788.
2. TEXT AMENDMENT
(1) Section 4 of By-law 1346/81 is hereby amended by adding
thereto the following definition:
(ab)
"Day Nursery - Type D" shall mean lands and premises
duly licenced pursuant to the Day Nurseries Act, or
any successor thereto, for use as a facility for the
daytime care of not more than eighty (80) children at
any one time.
(2) Section 5.A.1 of By-law 1346/81 is hereby amended by adding
thereto the following:
(b) day nursery - type 'D', but only on that portion of
the lands designated "RMII" which comprise Part 1,
Plan 40R-6788.
EFFECTIVE DATE
This By-law shall take effect from the day of passing hereof,
subject to the approval of the Ontario Municipal Board, if
required.
