HomeMy WebLinkAboutBy-law 1688/83THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 1688/83 Being a Restricted Area By-law to amend Restricted Area By-law 2511, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, within the boundaries of the Town of Pickering. WHEREAS the Council of the Corporation of the Town of Pickering deems it desirable to amend the definitions, general provisions for all zones; and AND WHEREAS an amendment to By-law 2511, as amended, is therefore deemed necessary; NOtI THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: SECTION 2 - DEFINITIONS, of By-law 2511, as amended, is hereby further amended as follows: (1) By adding thereto the following: 2.7.1 BUILDING "Building" shall mean a structure occupying an area greater than 9.5 square metres consisting of a wall, roof and floor, or any one or more of them, or a structural system serving the function thereof, including all the works fixtures and service systems appurtenant thereto. 2.25.1 DWELLING, SINGLE OR SINGLE DWELLING "Dwelling, Single" shall containing one dwelling accessory thereto. mean a dwelling unit and uses 2.52.1 MOBILE HOME "Mobile Home" shall mean a prefabricated building, designed to be towed on its own chassis notwithstanding that its running gear is or may be removed, and equipped for year-round occupancy and containing therein facilities for cooking or for the installation of cooking equipment as well as sanitary facilities including a flush toilet and a shower or bathtub, but shall not include a trailer. 2.74.1 STRUCTURE (2) "Structure" shall mean anything installed, constructed or erected, the use of which requires location on the ground, or attach- ment to something having location on the ground and, without limiting the generality of the foregoing, includes a vehicle as defined in the Highway Traffic Act, but does not include an inground swimming pool. By revoking Subsections 2.20, 2.24, 2.25, 2.26, 2.27, 2.33, and Clause I of Subsection 2.38 and substituting therefor the following: 2.20 DWELLING "Dwelling" shall mean a building or part of a building containing one or more dwelling units, but does not include a mobile home or a trailer. continued.. 2.24 DWELLING, DETACHED OR DETACHED DWELLING "Dwelling, Detached" shall mean a single dwelling which is freestanding, separate and detached from other main buildings or structures. 2.25 DWELLING, SEMI-DETACHED OR SEMI-DETACHED DWELLING "Dwelling, Semi-detached" shall mean one of a pair of single dwellings, such dwelling being attached together horizontally by an above- grade common wall. 2.26 DWELLING UNIT "Dwelling Unit" shall mean one or more habitable rooms occupied or capable of being occupied as a single, independent and separate housekeeping unit containing a separate kitchen and sanitary facilities. 2.27 DWELLING UNIT AREA "Dwelling Unit Area" shall mean the aggregate of the floor areas of all habitable rooms of a dwel- ling unit. 2.33 FLOOR AREA "Floor Area" shall mean the area of the floor surface contained within the outside walls of a storey or part of a storey. 2.38.1 GROSS FLOOR AREA "Gross Floor Area" shall mean the aggregate of the floor areas of all the storeys of a building or structure, or a part thereof as the case may be, other than a private garage, an attic or a cellar. 2. SECTION 5 - GENERAL PROVISIONS TO ALL ZONES, of By-law 2520, as amended, is hereby further amended as follows: (1) By revoking Clause 1 of Subsection 5.21 in its entirety and substituting therefor the following: 5.21.1 MINIMUM OFF STREET PARKING REQUIREMENTS Minimum off street parking for any lot in any zone shall be provided on the same lot in accordance with the following table: USE OF BUILDING OR SITE MINIMUM NUMBER OF PARKING SPACES 1. Residential detached dwelling 1 space per dwelling unit permitted businesses, except home occupations multiple family horizontal: I space per 28 square metres gross floor area devoted to permitted businesses for customers. without attached garage 2 spaces per unit, for occupants and visitors. with attached garage 1 garage space per unit, for occupants, where there is sufficient driveway space in front of each garage for 1 additional car per unit. continued.. USE OF BUILDING OR SITE with attached garage cont'd multiple family vertical MINIMUM NUMBER OF PARKING SPACES This driveway space must not lead to a parking area other than a garage space. 1 space for each 4 units or portion thereof, for visitors. 1 3/4 spaces per unit, for occupants and visitors. 2. Other Uses schools, elementary (junior and senior) and nursery, secondary, vocational, private post secondary churches, religious institutions I space yor each staff member 1 bus space per 8 classrooms 1 space for each staff member I bus space per 20 classrooms and i space per 10 students I space for each staff member and 1 space per 6 students 1 space per 4 persons capacity continued.. public buildings, libraries Veterinary or dental offices or clinic, or home occupations arenas Uses permitted by this By-law other than those listed in this table. i space per 24 square metres gross floor area 5 spaces per practitioner 1 space per 5.6 square metres area used for assembly plus I space per 18 square metres floor area used for sports, entertainment, restaurant, (excluding snack bar) and other ancillary uses. plus I bus parking space per dressing room. plus loading and unloading areas separate from the parking area, but may include a part of a driveway not leading to a parking area. plus controlled access from public roads to the parking area. 1 space per 93 square metres gross floor area· (2) By adding to Section 5 the following subsections: 5.29 TRUCK, BUS AND COACH BODIES No truck, bus, coach or streetcar body, or structure of any kind, other than a dwelling unit, erected and used in accordance with this and all other By-laws of the Town, shall be used as a dwelling unit within the area affected by this By-law, whether or not the same is mounted on wheels. 5.30 TRAILER PARKS AND PRIVATE RECREATIONAL USES The establishment of trailer parks, mobile home parks, private clubs, commercial clubs, camping establishments or private recreational parks shall be prohibited within the area covered by this By-law, save and except where such are specifically permitted. 5.31 SERVICES No dwelling unit shall be permitted on any lot within the area affected by this By-law, unless such a lot is served either by a public water system and a sanitary sewer system or by a private water and effluent disposal system that has been approved by the Region of Durham Health Unit. continued.. 3.
