HomeMy WebLinkAboutBy-law 1653/83THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 165783 Being a by-law to authorize the execution of a Release of certain covenants contained in the Deed dated November 13th, 1972 (page 1) and June 19, 1973 (back page), registered June 28th, 1973 as Instrument No. 240906, between the Corporation of the Township of Pickering and Manville Road Warehousing Limited WHEREAS, the Corporation of the Township of Pickering conveyed certain lands in Lot 19th, Range 3, Broken Front Concession (Parts 1 and 2, Plan 40R-809) to Manville Road Steel Warehousing Limited, subject to certain conditions; and WHEREAS, the Corporation of the Town of Pickering, as successor to the Corporation of the Township of Picketing, wishes to release Manville Road Steel Warehousing Limited from certain of such covenants; NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: The Mayor and Clerk are hereby authorized to execute a Release, in the form attached hereto as Schedule "A", of the covenants contained therein and in a Deed dated November 13th, 1972 (Page 1) and June 19th, 1973 (back page), registered June 2Bth, 193 as Instrument No. 240906, between the Corporation of the Township of Pickering and Manville Road Warehousing Limited. BY-LAW read a first, April, 1983. second and third time and finally passed this 18th day of RELEASE Dated April 18th, 1983 WHEREAS, by Deed dated November 13th, 1972 (page 1) and June 29th, 1973 (back page) registered June 28th, 1973 as Instrument No. 240906, the Corporation of the Township of Pickering conveyed to Manville Road Steel Warehousing Limited part of Lot 19, Range 3, Broken Front Concession, Pickering subject to certain covenants and agreements set out therein; and WHEREAS, the Corporation of the Town of Pickering is the successor to the Corpor- ation of the Township of Pickering; WITNESSETH THAT, in consideration of the sum of Two Dollars ($2.00) paid to it, receipt of which is hereby by it acknowledged, THE CORPORATION OF THE TOWN OF PICKERING, on its behalf and on behalf of its successors and assigns, and as successor to The Corporation of the Township of Picketing, hereby releases MANVILLE ROAD STEEL WAREHOUSING LIMITED and its successors and assigns, from those covenants, and all obligations thereunder, that are both, (a) contained in the Deed dated November 13th, 1972 (page 1) and June 19th, 1973 (back page), registered June 28th, 1973 as Instrument No. 240906, between the Corporation of the Township of Picketing and Manville Road Warehousing Limited, and (b) set out in Schedule B hereto, respecting the lands more particularly described in Schedule A hereto, which are the lands affected hereby. IN WITNESS WHEREOF the Corporation of the Town of Pickering has hereunto affixed its corporate seal attested by its properly authorized officers April 18th, 1983. SIGNED, SEALED & DELIVERED THE CORPORATION OF THE TOWN OF PICKERING Mayor Clerk SCHEDULE A ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the Town of Picketing, in the Regional Municipality of Durham and Province of Ontario and being those parts of Lot 19, Range 3, Broken Front Conces- sion, designated as Parts ] and 2 on a plan deposited in the Land Registry Office for the Land Registry Division of Durham (No. 40) as Plan 40R-809; SUBJECT TO and reserving unto the Grantor, its successors and assigns a right in the nature of an easement to enter upon that part of the said lands designated as Part 2 for the purpose of constructing and maintaining sewers and drains and for the repair and maintenance thereof and to enter upon Parts 1 and 2 of the said ]ands not built upon for the purpose of grading for surface drainage, provided that disruption to the Grantee shall be kept to a minimum and that the said lands are restored to the same state as that existing prior to the Grantor's entry for the purposes herein set out · SCHEDULE B THE Grantee herein also covenants and agrees that if any part of the real property is not built upon and is to be sold within 15 years after April 30th, 1973, the Grantor shall have the first right to purchase such part of the real property at the price of Eleven Thousand Five Hundred Dollars ($11,500.00) per acre, free of all encum- brances and subject to the usual adjustments, such right to purchase to be exercised within 14 days of receipt of notice from the Grantee herein that the property is to be sold and such purchase to be completed within 60 days of receipt of such notice, if the said right to purchase is exercised. The Grantee herein shall send by prepaid registered mail a notice in writing to the Grantor at its Municipal Offices forthwith upon offering any part of its land for sale. THE Grantee shall obtain covenants in the form Of the preceding two paragraphs and the covenant required in this paragraph from any person purchasing or otherwise acquiring the subject lands, or any part of them, from the said Grantee.
