HomeMy WebLinkAboutBy-law 1628/83THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 1628/83 Being a by-law to authorize the execution of an Agreement between Maple Ridge Homes Ltd. and the Corporation of the Town of Pickerin9 to amend the Subdivision Agree- ment dated March 2nd, 1981 between Maple Ridge Homes Ltd. and the Town respecting the development of Plan M-1222, Pickering WHEREAS the Corporation of the Town of Pickering entered into a Subdivision Agreement with Maple Ridge Homes Ltd. on March 2nd, 1981 to provide for the development of Plan M-1222, Pickering; and WHEREAS the Corporation of the Town of Pickering entered into an Amending Agreement with Maple Ridge Homes Ltd. on May 4th, 1981, to amend the provisions of the Subdivi- sion Agreement in certain respects; and WHEREAS it is now deemed appropriate further to amend the said Subdivision Agreement in certain respects; NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: The Mayor and Clerk are hereby authorized to execute an Agreement, in the form attached hereto as Schedule "A", between Maple Ridge Homes Ltd. and the Corpora- tion of the Town of Pickering to amend the Subdivision Agreement dated March 2nd, 1981 between Maple Ridge Homes Ltd. and the Corporation of the Town of Pickering with respect to the development of Plan M-1222, Pickering (Maple Ridge North). BY-LAW read a first, second and third time and finally passed this 21st day of February, 1983. M~yor /~ /? Schedule "A" to By-law Number 1628/83 THIS AGREEMENT made in triplicate this day of , 1983. BETWEEN: MAPLE RIDGE HOMES LTD. hereinafter called the "Owner" OF THE FIRST PART, - and- THE CORPORATION OF THE TOWN OF PICKERING hereinafter called the "Town" OF THE SECOND PART. WHEREAS by Agreement dated March 2nd, t981, between the Owner, the Town, June Van- denberg, The Royal Bank of Canada, and E.J.R. Phillips Investments Limited, the Owner proposed to subdivide and register, with the consent of the latter three Parties, a plan of subdivision of those parts of Lot 24, Concession 2, Pickering, comprising Ministry of Housing Draft Plan Number 18T-80021; and WHEREAS the plan was registered on August 4th, 1981, as Plan M-1222; and WHEREAS by Agreement dated May 4th, 1981, and registered on , as Instrument No. LT131598, between the Owner herein, the Town, June Vandenberg, The Royal Bank of Canada, and E.J.R. Phillips Investments Limited, certain amendments were made to the former Agreement; and WHEREAS it is deemed desirable to amend further the said Agreement in certain respects; NOW THEREFbRE, THIS AGREEMENT WITNESSETH THAT, in consideration of the sum of Two Dollars ($2.00) paid by each Party to the other, receipt of which by each is hereby acknowledged, the Parties hereto agree as follows: The lands affected by this Agreement are: ALL AND SINGULAR those certain parcels or tracts of land and premises situate, lying and being in the Town of Pickering, in the Regional Municipality of Durham and Province of Ontario and being composed of the whole of Lots 1 to 130, inclu- sive, according to a plan registered in the Land Titles Office for the Registry Division of Durham (No. 40) as Plan M-1222. In this Agreement, the term, (al "Subdivision Agreement" shall mean the Agreement dated March 2nd, 1981, Notice of which was registered on as Instrument No. LT131597, between the Owner, the Town, June Vandenberg, The Royal Bank of Canada and E.J.R. Phillips Investments Limited; and - 2- (b) "First Amendment Agreement" shall mean the Agreement dated May 4th, lg81, and registered on as Instrument No. LT131598 , between the Owner, the Town, June Vandenberg, The Royal Bank of Canada and E.J.R. Phillips Investments Limited. The Owner acknowledges and agrees that it is bound by all the terms and provi- sions of the Subdivision Agreement as amended by the First Amendment Agreement. 5 Section 22 of the Subdivision Agreement is amended by deleting "two (2)" from the third line thereof and by substituting "three (3)" therefor. Be Subsection (4) of section 24 of the Subdivision Agreement is amended by deleting "eighteen (18)" from the second and third lines thereof and by substituting "thirty (30)" therefor. 6. Time shall be of the essence of this Agreement. This Agreement and everything herein contained shall enure to the benefit of and be binding upon the Parties hereto, their successors and assigns. IN WITNESS WHEREOF the Owner and the Town have hereunto affixed their respective corporate seals, attested to by the hands of their proper officers authorized in that behalf.
