HomeMy WebLinkAboutBy-law 1912/84THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 1912 /84 Being a by-law to authorize the execution of a Quit Claim Deed from the Corporation of the Town of Pickering to Ontario Hydro respecting a Storm Sewer Easement over Part Lot 19, Range 3, Brok- en Front Concession (Parts 9, 10 and 11, Plan 40R-3123; Feldspar Court) WHEREAS the Corporation of the Town of Pickering is the owner of a Storm Sewer Outfall Easement over lands owned by Ontario Hydro, being those parts of Lot 19, Range 3, Broken Front Concession, designated as Parts 9, 10 and 11, Plan 40R-3123; and WHEREAS, the Town no longer requires such easement; NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: The Mayor and Clerk are hereby authorized to execute a Quit Claim of Ease- ment, in the form attached hereto as Schedule A between the Corporation of the Town of Pickering and Ontario Hydro respecting a Storm Sewer Outfall Easement in that part of Lot 19, Range 3, Broken Front Concession, Picketing, designat- ed as Parts 9, 10 and 11, Plan 40R-2123 (Feldspar Court). Schedule A to B~,-law Number 1912L84 THIS INDENTURE made this 15th day of October, 1984 BETWEEN THE CORPORATION OF THE TOWN OF PICKERING, herein called the "Grantor", OF THE FIRST PART, and ONTARIO HYDRO, herein called the "Grantee", OF THE SECOND PART, WHEREAS, by Instrument D57760, dated October ]9th, 1976 and registered in the Land Registry Office for the Land Registry Division of Durham (No. 40) October 26th, 1977, Ontario Hydro granted easement rights to Torwest Properties Limited over those lands described below; and WHEREAS, by Instrument D76415, dated February 13th, 1978, and registered in the said Office September 8th, 1978, Torwest Properties Limited, with the consent of Ontario Hydro, assigned those easement rights to The Corporation of the Town of Pickering; and WHEREAS The Corporation of the Town of Pickering, the Grantor herein, no longer requires those easement rights; WITNESSETH that in the consideration of the sum of two dollars now paid by the Grantee to the Grantor (receipt whereof is hereby by it acknowledged), the Grantor does hereby grant, release and quit claim unto the Grantee, its successors and assigns, all estate, right, title, interest, claim and demand whatsoever, both at law and in equity or otherwise howsoever, and whether in possession or expectancy, of the Grantor, of, in, to or out of, ALL AND SINGULAR those certain parcels or tracts of lands and premises situate, lying and being in the Town of Pickering, in the Regional Municipality of Durham (formerly in the Township of Picketing in the County of Ontario) and Province of Ontario and being those portions of Lot 19, Range 3, Broken Front Concession, designated as Parts 9, 10 and 11, Plan 40R-3123, TO HOLD the said lands unto and to the use of the Grantee is successors and as- signs, forever.
