HomeMy WebLinkAboutBy-law 1864/84THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 1864/84 Being a Zoning By-law to amend Restricted Area (Zoning) By-law 3036 as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, in Part Lot 5, Plan 489, in the Town of Pickering. (A 5/84) WHEREAS the Council of the Corporation of the Town of Pickering deems it desirable to allow the establishment of a dance studio in addition to uses presently permitted on the subject lands; AND WHEREAS an amendment to By-law 3036, as amended, is therefore deemed necessary; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. BY-LAW 3036 By-law 3036, passed by Council of the Corporation of the Township (now Town) of Picketing on the 3rd day of August 1965, and approved by the Ontario Municipal Board on the 7th day of October, 1966 and amended from time to time, is hereby further amended only to the extent necessary to give effect to the provisions of this by-law. o TEXT AMENDMENT Section 9 of By-law 3036, as amended, is hereby further amended by adding thereto the following subsection: 9.3.3.5 Part Lot 5, Plan 489 (1) For the purpose of this subsection, the terms (a) "Public School" shall mean, (i) a school under the jurisdiction of a board of education which board is established pursuant to The Education Act, 1974, or any successor thereto; (ii) a college of applied arts and technology established pursuant to The Ministry of Colleges and Universities Act, 1971, or any successor thereto; (iii) a university eligible to receive provincial funding from the Minister of Colleges and Universities, pursuant to The Universities Act, 1971, or any successor thereto. continued... Page 2 b) "Private Non-Residential School" shall mean a school which is maintained for educational or religious purposes but shall not include any other school defined herein. c) "Private Residential School" shall mean a school which is maintained for educational or religious purposes and which includes accessory residential facilities but shall not include any other school defined herein. d) "Commercial School" shall mean a school which is operated for gain or profit and may include the studio of a dancing teacher or music teacher, or an art school, a golf school or any other such school operated for gain or profit, but shall not include any other school defined herein. e) "Day Nursery" shall mean lands and premises duly licenced pursuant to the provisions of The Day Nurseries Act, or any successor thereto, and for the use as a facility for the daytime care of children. Notwithstanding any of the provisions of this By-law, in addition to any other uses that may be permitted thereon, the lands hatched on Schedule "I" to By-law 1864/84 may be used for the purpose of a commercial school subject to the following provisions: (al only the studio of a dancing teacher shall be permitted. (b) the gross floor area of a studio of a dancing teacher shall not exceed 93 square metres. 3. EFFECTIVE DATE This By-law shall take effect from the day of passing hereof, subject to the approval of the Ontario Municipal Board, if required. BY-LAW 3036 By-law 3036 , passed by Council of the Corporation of the Township (now Town) of Pickering on the 3rd day of August 1965 , and approved by the Ontario Municipal Board on the 7th day of October , 1966 and amended from time to time , is hereby further amended only to the extent necessary to give effect to the provisions of this by-law. 2 . TEXT AMENDMENT Section 9 of By-law 3036 , is hereby further amended by adding thereto the following subsection: 9 .3 .3 .5 Part Lot 5 , Plan 489 ( 1 ) Notwithstanding any of the provisions of the zoning by-law, in addition to any other use that may be O.M.B. File permitted thereon , the lands hatched on Schedule "I" R840563 to By-law 1864/84 may be used for the purpose of a children' s dancing studio provided , firstly, that Order dated such studio is located only in the basement of the May 8 , 1985 dwelling house existing on such lands on July 3 , 1984 , secondly, that the owner and operator of such studio resides in such dwelling house and thirdly, that the gross floor area of such studio does not exceed 93 square metres. 3 . EFFECTIVE DATE This by-law shall take effect in accordance with the provisions of the Planning Act, 1983 . READ A FIRST AND SECOND TIME THIS 3RD DAY OF JULY , 1984 .
