BY-LAW NUMBER 1863/84
Being a Zoning By-law to amend Restricted
Area (Zoning) By-law 2520, as amended, to
implement the Official Plan of the Town of
Pickering District Planning Area, Region
of Durham, in Lot 367, Plan M-17, in the
lown of Picketing. (A B/84)
WHEREAS the Council of the Corporation of the Town of Pickering
deems it desirable to allow the establishment of a flursery school
on the subject lands;
AND WHEREAS an amendment to By-law 2520, as amended, is therefore
deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPDRATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. BY-LAW 2520
By-law 2520, passed by Council of the Corporation of the
Township (now Town) of Pickering on the 5th day of October
1960, and approved by the Ontario Municipal Board on the
3rd day of January, 1963 and amended from time to time,
is hereby further amended only to the extent necessary to
give effect to the provisions of this by-law.
TEXT AMENDMENT
Section 7 of By-law 2520, as amended, is hereby further
amended by adding thereto the following subsection:
7.2.7. Lot 367, Plan M-17
(1)
For the purpose of this subsection, the term 'Day
Nursery, Type C' shall mean lands and premises duly
licenced pursuant to The Day Nurseries Act, or any
successor thereto, for use as a facility for the
daytime care of not more than fifteen children
at any one time.
(2)
Notwithstanding any of the provisions of this By-law,
in addition to any other uses that may be permitted
thereon, the lands designated "R4(DN)" on Schedule "I"
to By-law 1863/84 may be used for the purpose of a
Day Nursery, Type C, subject to the following provision:
(a) no outdoor activity area shall be permitted.
SCHEDULE AMENDMENT
Schedule "A" to By-law 2520, as amended, is hereby further
amended-by altering from "R4" to "R4(DN)" the zone designation
of the lands designated "R4(DN)" on Schedule "I" hereto.
