HomeMy WebLinkAboutBy-law 1862/84THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 1862/84 Being a Zoning By-law to amend Restricted Area (Zoning) By-law 2511, as amended,.to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, in Lots 64, 65 and 66, Plan 350, in the Town of Picketing. (A 11/84) WHEREAS the Council of the Corporation of the Town of Pickering passed By-law 1399/81, amending By-law 2511 to permit the establishment of a day nursery on the subject land, being Lots 64, 65 and 66, Plan 350, in the Town of Picketing; AND WHEREAS the Council of the Corporation of the Town of Pickering now deems it desirable to further amend By-law 2511, as amended by By-law 1399/81 to permit the establishment of a private non-residential school; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. TEXT AMENDMENT Section 10.3.2 of By-law 2511, as added by By-law 1399/81, is hereby amended by adding thereto the following: (3) For the purpose of this subsection the terms (a) "Public School" shall mean, a school under the jurisdiction of a board Of education which board is £~tabtished pursuant to The Education Act, 1974, or any successor thereto; (ii) a college of applied arts and technology established pursuant to the Ministry of Colleges and Universities Act, 1971, or any successor thereto; (iii) a university eligible to receive provincial funding from the Minister of Colleges and Universities, pursuant to The Universities Act, 1971, or any successor thereto. (b) "Private Non-Residential School" shall mean a school which is maintained for educational or religious purposes but shall not include any other school defined herein. (c) "Private Residential School" shall mean a school which is maintained for educational or religious purposes and which includes accessory residential facilities but shall not include any other school defined herein. (d) "Commercial School" shall mean a school which is operated for gain or profit and may include the studio of a dancing teacher or music teacher, or an art school, a golf school or any other such school operated for gain or profit, but shall not include any other school defined herein. continued... Page 2 (4) (s) Notwithstanding any of the provisions of this By-law, in addition to any other uses that may be permitted thereon, the lands designated "R4(DN)" on Schedule "I" to By-law 1399/81 may be used for the purpose of a Private Non- Residential School. SPECIAL RESTRICTIONS FOR A DAY NURSERY, TYPE A AND A PRIVATE NON-RESIDENTIAL SCHOOL The aggregate shall not exceed 100 of (a} the number of children enrolled in each day nursery, type A and (b) the number of persons enrolled in each private non-residential school at any one time. o EFFECTIVE DATE This By-law shall take thereof subject to the Board, if required. effect from the day of passing approval of the Ontario Municipal READ A FIRST AND SECOND TIME THIS 3rd DAY OF July ,1984.
