HomeMy WebLinkAboutBy-law 1823/84THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 1823 /84 Being a by-law to authorize the execution of a deed conveying part of Lot 4, Concession 6, Pickering (Parts 2, 3 and 4, Plan 40R-7951) to Antonio Scavetta. WHEREAS, the Corporation of the Town of Pickering is the owner of certain lands in Lot 4, Concession 6, Pickering, now designated as Parts 2, 3 and 4, Plan 40R-7951; WHEREAS, pursuant to the provisions of section 193(1) of the Municipal Act, R.S.O., 1980, chapter 302, the Council of the Corporation of the Town of Pickering may dispose of lands no longer required for municipal purposes; NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: The Mayor and Clerk are hereby authorized to execute a deed in the form attached hereto as Schedule A, conveying to Antonio Scavetta those parts of Lot 4, Concession 6, Pickering designated as Parts 2, 3 and 4, Plan 40R-7951. BY-LAW read a first, second and third time and finally passed this 16th April , 1984. day of Schedule A to B~;-law 1823/84 THIS INDENTURE made this 5th day of April, 1984. In Pursuance of The Short Forms of Conveyances Act BETWEEN: THE CORPORATION OF THE TOWN OF PICKERING hereinafter called the "Grantor", OF THE FIRST PART, - and - ANTONIO SCAVETTA, of the Town of Pickering, in the Regional Municipality of Durham hereinafter called the "Grantee", OF TtlE SECOND PART. WITNESSETH that in consideration of the sum of Two ($2.00) Dollars of lawful money of Canada now paid by the Grantee to the Grantor (receipt whereof is hereby acknowleged), the Grantor doth grant unto the Grantee in fee simple. ALL AND SINGULAR those certain parcels or tracts of land and premises situate lying and being in the Town of Pickering, in the Regional Municipality of Durham, and being composed of Parts of Lot 4, Concession 6, in the Town of Pickering, in the Regional Municipality of Durham, and Province of Ontario, more particularly described as Parts 2, 3 and 4 on Plan 40R-7951. TO HAVE AND TO HOLD unto the Grantee his heirs, executors, administrators, successors and assigns, to and for his and their sole and only use for ever. Subject nevertheless to the reservations, limitations, provisoes and conditions, expressed in the original grant thereof from the Crown. The Grantor covenants with the Grantee that it has the right to convey the said lands to the Grantee notwithstanding any act of the Grantor And that the Grantee shall have quiet possession of the said lands, free from all encumbrances. And the Grantor covenants with the Grantee that it will execute such further assur- ances of the said lands as may be requisite. And the Grantor covenants with the Grantee that it has done no act to encumber the said lands. And the Grantor releases to the Grantee all its claims upon the said lands.
