Young The meeting convened at 7:03 p.m. in the Main Committee Room of the Civic Complex. 1. MATTERS ARISING FROM THE MINUTES There were no matters arising from the minutes. 2. ADOPTION OF MINUTES MOTION: Moved by Ms. Billinger, seconded by Mr. Newton and carried unanimously- That the minutes of the 14th meeting of the Committee of Adjustment held October 16, 2002, be adopted. MOTION CARRIED 3. ADOPTION OF AGENDA MOTION: Moved by Mr. Newton, seconded by Mr. Mohr and carried unanimously- That the agenda for the November 6, 2002 meeting be adopted. MOTION CARRIED 86 4. (Tabled from June 12, 2002 meeting) PICA 27/02 - M. Blackhurst & P. Morrissey 1358 Tatra Drive East Part of Lot 54, Plan M-14 City of Pickering MOTION: Moved by Mr. Mohr, seconded by Ms. Billinger and carried unanimously- That item PICA 27/02, by M. Blackhurst & P. Morrissey be lifted from the table. MOTION CARRIED The applicant requests relief from the following provisions of Zoning By-law 2520, as amended: Section 8.2.3 to permit the establishment of a minimum 6.1 metre front yard depth to be provided by a proposed front porch addition to the existing dwelling, whereas the by-law requires a minimum front yard depth of 7.5 metres; Section 8.2.3 to permit the establishment of a minimum 0.1 of a metre east side yard width to be provided by the proposed sunroom addition, whereas the by-law requires a minimum side yard width of 2.4 metres; Section 8.2.5 to permit the establishment of a maximum lot coverage of 48% to be provided by the existing dwelling, and the proposed sunroom and front porch additions, whereas the by-law permits a maximum lot coverage of 33% and PICA 47/98 permits a maximum lot coverage of 45%. Ms. Taylor outlined comments received from the City of Pickering Planning & Development Department. Written comments were received from, the City's Fire Prevention Officer and Development Control Supervisor, both expressing no concerns. Verbal comments were received from the Chief Building Official stating that the applicant has now complied with the previous Committee of Adjustment decision and resolved related building matters. Mr. Blackhurst, owner, was present to represent the application. No further representation was present in favour of or in objection to the application. Mr. Blackhurst submitted 3 letters of support from abutting neighbours to the east side, west side, and directly across the street of the subject property. Mr. Blackhurst stated that he would like the addition to give his children a safe place to play. He intends to access the rear yard through a set of sliding glass doors. Committee members inquired as to fire access, possible reduction in width of the addition and the applicants' intent to access the addition. Ms. Taylor stated that Fire Prevention did not indicate any concerns with respect to accessing the rear yard of the subject property. Mr. Blackhurst replied that the addition would be the width of the existing carport and intends to access the addition through an existing side door entrance. 87 Mr. Mohr stated that with all due respect to Staff's recommendation he would be supporting the side yard width variance and outlined the following reasons: . abutting neighbours have no objections; . Committee does not set precedent; . the driveway location of the easterly-abutting property would reduce the mass of the structure; . does not feel that the addition is disruptive. DECISION: Moved by Mr. Mohr, seconded by Ms. Billinger and carried unanimously that- Application PICA 27/02 by M. Blackhurst & P. Morrissey, as outlined be APPROVED on the grounds that the proposed establishment of a minimum 6.1 metre front yard depth to be provided by a proposed front porch addition, proposed establishment of a minimum 0.1 of a metre east side yard width to be provided by the proposed sun room addition, and a maximum lot coverage of 48% are minor variances that are desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: 1. That these variances apply only to the proposed front porch addition and proposed sunroom addition as generally sited and outlined on the applicant's submitted plans with this application. 2. That the applicant obtain building permits and construct the proposed front porch addition and sunroom addition within two years of the date of this decision, or this decision shall become null and void. 5. PICA 64/02 - Dennis Austin 1384 Tatra Drive Lot 45, Plan M-14 City of Pickering The applicant requests relief from Section 5.8.(b) of Zoning By-law 2520, as amended, in order to permit the continuance of a deck to project a maximum of 1.6 metres, resulting in a minimum front yard depth of 5.9 metres, whereas the by-law permits uncovered platforms and decks not exceeding 1.0 metre in height above grade to project a maximum of 1.5 metres into a required front yard depth of 7.5 metres. 88 The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were received from the City's Fire Prevention Officer and Development Control Supervisor, both expressing no concerns. Mr. Austin, owner, was present to represent the application. No further representation was present in favour of or in objection to the application. Mr. Austin stated that he concurred with Staff's recommendation. DECISION: Moved by Ms. Billinger, seconded by Mr. Mohr and carried unanimously that- application PICA 64/02 by Dennis Austin, as outlined be APPROVED on the grounds that the proposed continuance of a deck to project a maximum of 1.6 metres into the required front yard of the detached dwelling, resulting in a minimum front yard depth of 5.9 metres is a minor variance that is desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following condition: 1. That this variance apply only to the existing deck, approximately 3.0 metres x 3.0 metres in size, and 1.1 metres in height, as generally sited and outlined on the applicant's submitted plans with this application. 6. PICA 66/02 - Samuel Wong 1893 Rosebank Road Lot 9, Plan 40M-1662 City of Pickering The applicant requests relief from Section 5(1 )(b)(vi) of Zoning By-law 3036, as amended by By-law 1837/84, to permit the establishment of a minimum 6.7 metre rear yard depth to be provided by a proposed sunroom addition, whereas the by-law requires a minimum rear yard depth of 7.5 metres. The Assistant Secretary-Treasurer outlined comments received from the City of Pickering Planning & Development Department. Written comments were received from the City's Fire Prevention Officer and Development Control Supervisor, both expressing no concerns. Mr. Mark Purdy of Lifestyle Sunrooms, was present to represent the application. No further representation was present in favour of or in objection to the application. Mr. Purdy stated that he concurred with Staff's recommendation. 89 DECISION: Moved by Mr. Newton, seconded by Ms. Billinger and carried unanimously that- application PICA 66/02 by Samuel Wong, as outlined be APPROVED on the grounds that the proposed establishment of a minimum 6.7 metre rear yard depth is a minor variance that is desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: 1. That this variance apply only to the proposed sunroom addition, approximately 4.8 metres by 2.7 metres in size, as generally sited and outlined on the applicant's submitted plans with this application. 2. That the applicant obtain a building permit and construct the proposed addition within two years of the date of this decision, or this decision shall become null and void. 7. ADJOURNMENT MOTION: Moved by Mr. Mohr, seconded by Ms. Billinger and carried unanimously that- The 15th meeting of the Committee of Adjustment be adjourned at 7:25 p.m. and the next meeting of the Committee of Adjustment be held on Wednesday, November 27,2002.
