HomeMy WebLinkAboutBy-law 2513/87THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 2513/87 Being a by-law to authorize the execution of an Agreement of Purchase and Sale for the acquisi- tion by the Town of Part Lot 21, Concession 1, (Part 26, Plan 40R-7765) and Block 16, Plan 40M-1231, Picketing. WHEREAS, pursuant to the provisions of the section 193(1) of the Municipal Act, R.S.O. 1980, chapter 302, the Council of The Corporation of the Town of Pickering wishes to acquire part of Lot 21, Concession 1, (Part 26, Plan 40R-7765) and Block 16, Plan 40M-1231, Pickering, for municipal purposes; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: The Mayor and Clerk are hereby authorized to execute an Agreement of Pur- chase and Sale, in the form attached hereto as Schedule A, providing for the acquisition by the Town of Part Lot 21, Concession 1, (Part 26, Plan 40R-7765) and Block 16, Plan 40M-1231, Pickering, for the sum of $150,000.00 per acre. The purchase price is based on 2.264 acres, at the rate of $150,000.00 per acre. In the event that prior to closing the Vendor furnishes a certificate from an Ontario Land Surveyor as to the exact acreage, the purchase price ~ill be adjusted accordingly. 4.On closing, the purchaser will accept the Vendor's undertaking, provided the funds are made payable to the first mortgagee, to obtain and register a discharge of the first mortgage on title, within sixty (60) days after closing. 5.The Purchaser will pass the necessary By-laws and resolutions necessary to enter into this Agreement and complete the transaction. 6.The closing of this transaction shall be the earlier of December 31st, 1987 o the date on which the Town of Pickering receives monies in lieu of park land from Discovery Place Limited (Tridel) in accordance with the terms and conditions of a Development Agreement between the Town of Pickering, Discovery Place Limited and J.D.S. Investments Limited. 4.
